Town of Mashpee <br /> 16 Great Neck Road North <br /> Mashpee, MA 02649 <br /> MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A MODIFICATION TO SPECIAL PERMIT(S) <br /> (SP-83-3-008, SP-00-167, SP-02-59, SP-2020-06) <br /> MOD-2023-32 <br /> Owner, 21 Frog Pond Close, LLC Bk.: 35840 <br /> 21 Frog Pond Close (Map 90 Parcel 83) Pg.: 57 <br /> 352 Mashpee Neck Road (Map 90 Parcel 97) Bk.: 35046 <br /> Mashpee, MA 02649 Pg.: 126 <br /> A Petition was filed on March 30,2023 by Owner, 21 Frog Pond Close, LLC requesting to modify <br /> the existing Special Permits of the marina use and expand to include the adjacent property located <br /> at 352 Mashpee Neck Road, Original Special Permits: (SP-83-3-008, SP-00-167, SP-02-59, and <br /> SP-2020-06), under §174-24 (C) (9) (b); §174-25 (E); and §174-17 of the Zoning Bylaws, on <br /> property located in an R-3 Zoning District, Map 90 Parcel 83 and Map 90 Parcel 97, Mashpee, <br /> MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. <br /> Notice was given by publication in The Mashpee Enterprise, a newspaper of general circulation in <br /> the Town of Mashpee, on May 5, 2023 and May 12, 2023 a copy of which is attached hereto and <br /> made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br /> Massachusetts General Laws Chapter 40A §9 and the Town of Mashpee Zoning By-laws. <br /> A Public Hearing was held at Mashpee Town Hall on Wednesday, May 24, 2023 at which time <br /> the following members of the Board of Appeals were present; Chairman, Jonathan Furbush, Vice <br /> Chairman, William Blaisdell, Ron Bonvie, Scott Goldstein, and Associate Member, Sharon <br /> Sangeleer. <br /> Attorney Christopher Kirrane represented the applicant for the Modification request to the existing <br /> Special Permits. Attorney Kirrane submitted a letter dated May 23, 2023 that was read into the <br /> record, requesting a continuance until the June 14, 2023 meeting. Attorney Kirrane met with Mr. <br /> David Morris,Building Commissioner, and Evan Lehrer, Town Planner,both recommending that <br /> this application be reviewed by the Department Heads at the Plan Review Committee meeting <br /> dated June 5, 2023, for the purpose of providing their recommendations to the Zoning Board of <br /> Appeals, and to allow time for Town Counsel to review the questions formally submitted by the <br /> Town Planner dated April 25, 2023. <br /> 1 <br />
