Town of Mashpee <br /> , 16 Great Neck Road North <br /> F <br /> Mashpee, MA 02649 <br /> MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A SPECIAL PERMIT <br /> SP-2023-34 <br /> Owners, The Popponesset Island Road LLC and Doc.: 1404422 <br /> Jonathan Bernstein, Trustee of 16 Popponesset Island Ctf.: 223515 <br /> Road Realty Trust Doc.: 1376987 <br /> 12 & 16 Popponesset Island Road Ctf.: 220333 <br /> (Map 105 Parcel 264) (Map 105 Parcel 266) <br /> Mashpee,MA 02649 <br /> A Petition was filed on May 4, 2023 by Owners, The Popponesset Island Road LLC and Jonathan <br /> Bernstein, Trustee of 16 Popponesset Island Road Realty Trust requests a Special Permit under <br /> §174-17.1 and §174-33 of the Zoning Bylaws to raze two existing dwellings, and construct one <br /> new conforming dwelling on the combined lots on property located in an R-3 Zoning District, 12 <br /> and 16 Popponesset Island Road, Map 105 Parcel 265, and Map 105 Parcel 266, Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. <br /> Notice was given by publication in The Mashpee Enterprise, a newspaper of general circulation in <br /> the Town of Mashpee, on May 19, 2023 and May 26, 2023 a copy of which is attached hereto and <br /> made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br /> Massachusetts General Laws Chapter 40A §9 and the Town of Mashpee Zoning By-laws. <br /> A Public Hearings was held on the request for a Special Permit at the Mashpee Town Hall on <br /> Wednesday, June 14, 2023, at which time the following members of the Board of Appeals were <br /> present; Chairman, Jonathan Furbush, Vice Chairman, William Blaisdell, Board Members, Ron <br /> Bonvie, Scott Goldstein, and Associate Member, Robert Caggiano. Chairman Furbush opened the <br /> meeting and heard testimony from Attorney, Michael Ford. <br /> Attorney, Michael Ford represented the raze and replace application for 12 and 16 Popponesset <br /> Island Road. Also present was Mark Dibb, Cape & Islands Engineering, and Andrew Sidford, <br /> Architect. Attorney Ford stated that the two properties are owned by the same person. Attorney <br /> Ford mentioned that under the bylaw Section 174-17.1 includes the wetlands setback for this <br /> project. <br /> The existing conditions plan depicts both homes; 12 Popponesset is a one-story house that is <br /> slightly over 2,300 sq. ft. and was built in the 1940's. The existing house on 16 Popponesset was <br /> built around 2006,and is a 7,500 sq. ft.two-story house.Attorney Ford referred to the"Ross Case" <br /> that both lots are non-conforming. <br /> 1 <br />
