<br /> SPECIAL PERMIT FINDINGS
<br /> The subject property located at 12 & 16 Popponesset Island Road combined approximately 39,640
<br /> square feet of land. The proposed is 43,776 square feet of land.
<br /> There were no abutters present.
<br /> In view of the foregoing, the Board determined the Petitioner met the criteria for a Special Permit.
<br /> Upon motion duly made and seconded at the Public Hearings on Wednesday, August 23, 2023,
<br /> the Zoning Board of Appeals voted unanimously to issue a Special Pen-nit to Owners, The
<br /> Popponesset Island Road LLC and Jonathan Bernstein, Trustee of 16 Popponesset Island Road
<br /> Realty Trust for 12 & 16 Popponesset Island Road under §174-17.1 and §174-33 of the Zoning
<br /> Bylaws to raze two existing dwellings, and construct one new conforming dwelling on the
<br /> combined lots on property located in an R-3 Zoning District, Map 105 Parcel 265 and Map 105
<br /> Parcel 266, Mashpee, MA with the following conditions:
<br /> 1. The Board has determined that the applicant meets all the conditions of a Special Permit
<br /> under Mass General Law 40A Section 9.
