MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A SPECIAL PERMIT <br /> Owners, The Popponesset Island Road LLC and <br /> Jonathan Bernstein, Trustee of <br /> 16 Popponesset Island Road Realty Trust <br /> 12 & 16 Popponesset Island Road <br /> (Map 105 Parcel 264) (Map 105 Parcel 266) <br /> Mashpee, MA 02649 <br /> SP-2023-34 <br /> 6. Any changes to the plans will require the applicant to return to this Board. <br /> 7. The Board finds that no new non-conformities are being created. <br /> 8. The Board finds there is sufficient land area to provide adequate parking. <br /> 9. The Board finds that the change,extension,alteration, or reconstruction of the pre-existing <br /> non-conformities (as they existed with respect to the two prior lots/structures) are not <br /> substantially more detrimental to the neighborhood than the pre-existing conditions of the <br /> subject lots. <br /> 10. Conditioned to remove the common lot line between the two existing lots,by the recording <br /> of a perimeter plan under the provisions MGL c. 41 Section 81P, or an 81X plan as <br /> required, and providing a copy of the recorded plan to the Building Commissioner and the <br /> Board of Appeals. <br /> I I. Conditioned placing both lots in common ownership and provide copies of the recorded <br /> deeds to the Building Commissioner and the Board of Appeals. <br /> 12. Conditioned on the documented existence and continuation of easement and driveway <br /> access on both driveways shown on the plans to be submitted to the Building Department <br /> and the Board of Appeals prior to issuance of a building permit. <br /> 9 <br />
