MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A WRITTEN FINDING <br /> Owners, Patrick J. Knight and Nissa R. Knight <br /> 25 Tide Run Road, Map 126 Parcel 40 <br /> Mashpee, MA 02649 <br /> FINDING-2023-38 <br /> Attorney Kirrane stated that the existing structure is being removed,but the existing foundation is <br /> remaining. There will be some expansion of the footprint that will include a two car garage, the <br /> entry way will be closed off and moved forward slightly. There's a significant portion of the deck <br /> that is within LSTCSF. The entire structure including the house and the decking will be removed <br /> from the LSTCSF, so there will be no structure within the flood zone. There will be a patio, and <br /> spa, but everything else will be removed from the LSTCSF. The Board of Health requires a new <br /> I/A system, and his client is agreeable to include that as a condition if approved by the Board. <br /> Chairman Furbush asked if the pool is within the LSTCSF. Attorney Kirrane said; yes, but was <br /> approved by the Conservation Commission. He is concerned with the draining aspect of the pool. <br /> Attorney Kirrane said that the pool is salt water, so there are no chemicals. <br /> Mr. Morris, Building Commissioner said that he required this project to apply with the Board <br /> because of setbacks from wetlands. <br /> GENERAL FINDINGS <br /> The subject property located at 25 Tide Run Road contains a total of sq. ft. of land. <br /> The minimum requirements in the Little Neck Bay Cluster Subdivision is: <br /> Minimum Lot Size— 15,000 sq. ft. <br /> Minimum Frontage—75 ft. <br /> Minimum Front Yard Setback—30 ft. <br /> Minimum Rear Yard Setback—20 ft. <br /> Minimum Side Yard Setback— 15 ft. <br /> Minimum Lot Coverage—30% <br /> Mr. Reidy read the Daniel Kent,Assistant Conservation Agent comments dated June 26,2023 into <br /> the record; "Commission approved additions to dwelling as well as hardscape, landscape, <br /> mitigation and modifications to pier on the property. " <br /> Mr. Goldstein asked if the sunroom is a heated space, and asked if Board of Health had any issues <br /> because it's a four bedroom system. The Board of Health reviews these projects during permitting. <br /> Mr. Reidy read the Board of Health comments dated June 28, 2023 into the record. "Septic was <br /> approved and installed for 4 bedroom before new town IIA regulations and State Title S. <br /> Recommend looking into upgrading septic tank to IIA technology while construction is going on <br /> before state enforces mandatory upgrades.
