Mr. Harrington: There is a proposal here before you.
CHAIR BAUMGAERTEL : What do you need from us tonight?
Mr. Harrington: I need a vote for an option for settlement.
CHAIR BAUMGAERTEL : I would like to mull it over a little bit more and get some additional
opinions from some colleagues to make sure we are not missing something. We have a meeting
next week, right?
Mr. Harrington: We do
CHAIR BAUMGAERTEL: We can do an executive session at that point and then vote to finally...we
have a 60 day timeline, I don't want to have to go to deep into the 60 day.
Mr. Harrington: We do. We have a 60 day stay, but I don't want to have it delayed too long. The
owner is pumping on a weekly basis and it's costing them money. We need to move this along.
CHAIR BAUMGAERTEL: Did you guys ask the designer Brian if he would be fairly easily implement
this?Or has he not given any opinion?
Mr. Harrington: He has not given any opinion, he just brought in Winston in to give them options
on what might be a reasonable and economic nitrogen removal system. Winston wanted to draw
something up, but I told he we were not at the draw-up stage, we just wanted a narrative,
something to explain what he thought might work.
CHAIR BAUMGAERTEL : It's not like a totally trivial change because there is a lot of design work
that goes with it.
Mr. Harrington: All the leaching fields are the same, so it would be typical for each field if he
draws it once.
CHAIR BAUMGAERTEL : Key difference is depth due to ground water.
Mr. Harrington: No issue with ground water. It will have to be vented since it's already under the
parking lot. The venting is really important.
CHAIR BAUMGAERTEL: We really don't have standing and if that's what Attorney Costello thinks,
if that's our only recourse I want to make sure I don't miss anything so 1 would like to take a week.
Mr. Harrington: I can look a little more into the remedial approval to see how it would apply
CHAIR BAUMGAERTEL : That's a bit of a change from what I would expect. I don't know if he's
talked to Mary Beth about doing that way or not. She's the one at DEP who oversees all the
approvals for these systems.
Mr. Harrington: Oh, yea, she's the head of the wastewater section
