Title 5 is up to $500/day, but typically its $25-$50 for just for risers. This is not a critical item or
a condemnable offense of either the environmental or sanitary code. But,the work has not
been done. Mr. Giancola was laid up for a bit, certainly the full 197 days, if you want to give
some credit there;that would reduce the 197 days, up to the board.
Due to 167 days of non-compliance and charge $25 per day, Kripani Patel motioned to issue a
fine of$4175 based upon the failure to comply with the BOH order of June 29, 2021. The fines
shall be paid within 10 days of receipt of the board's decision. Failure to pay the fines shall
subject the owner to additional fines and/or court action. At that time, the Board was considering an application for a new Hotel Permit
that was submitted by Willowbend in August 2020, but members wanted an explanation why a
permit had not been sought sooner, since they had been operating for many years. At the
January 6th meeting, Board members agreed that, even though no action was taken by the Board
on the application in 2020, Willowbend was not completely blameless, in that they failed to
follow up on the status of their application and continued to operate without a permit even after
it was brought to their attention. The Board requested that Health Agents send a letter
requesting a representative from Willowbend attend an upcoming meeting to offer an
explanation. There was a delay in scheduling the required public hearing for a new Hotel Permit,
due to an oversight on the part of the Mashpee Enterprise in publishing the public hearing notice.
Mr. Harrington suggests that the board close this out and move on.
There being no further comments or discussion, Kripani Patel motioned to approve the
application of Southworth Willowbend LLC for a Hotel Permit on the condition of an inspection
by a health agent.
