MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> JANUARY 24,2024 <br /> The structure itself is nonconforming in only two aspects; lot coverage because of the flood zone, <br /> and setback to wetlands because of the impact of the flood zone. This project will be in compliance <br /> with all other setbacks. A new I/A system will be installed to comply with the Board of Health <br /> regulations. This project has been issued a superseding order of conditions from the (DEP) <br /> Department of Environmental Protection stating this project is a better project than what currently <br /> exists on site. The Conservation Commission does not have any jurisdiction on this project, and <br /> there are no appeals on this project. The structure's existing coverage is 6.2%, and proposed is <br /> 15.4%and is under the 20%requirement.Attorney Kirrane provided a narrative that included other <br /> homes in the neighborhood that were approved by this Board. There are no new nonconformities <br /> being created. <br /> Mr. Reidy read the Conservation Department comments dated January 23, 2024 into the record. <br /> Mr. Reidy read a letter dated December 26, 2023 from (DEP) Department of Environmental <br /> Protection to Watsky Law (to summarize); "The proposed project will result in an improvement <br /> over the existing site conditions. A non flood compliance house will be replaced with a new house <br /> in accordance with the Massachusetts State Building Code standards for Flood Resistant <br /> Construction. " <br /> Mr. Reidy also read Evan Lehrer's recommendation into the record. Mr. Reidy mentioned that <br /> Mark Dibb provided his response to comments made by Evan Lehrer and were noted into the <br /> record. <br /> Mr.Bonvie asked the Board members if they read the remarks written by Mark Dibb.The members <br /> did in fact read the remarks.Mr.Bonvie asked the audience if they wanted the remarks read aloud. <br /> There were no comments. <br /> Mr. Reidy read the Board of Health comments dated January 22, 2024 into the record; "Septic is <br /> only design for four bedrooms, plans show three bedrooms in main house second floor, and one <br /> bedroom above garage this is compliant. " <br /> Mr. Dibb mentioned that the lot coverage increase of the structure from 1,274 to 3,200, increasing <br /> 2,000 sq. ft. but under the 20%. The comments regarding the flood plain. This project also went <br /> through MEPA to review the project. The project did not get"scoped". <br /> Mr. Bonvie mentioned he was amazed that this project did not get "scoped" by MEPA. He <br /> described the definition of"scope"that would require research of the land area for historic artifacts. <br /> 6 <br />
