Spencer request a Special Permit under§174- <br /> 17.1 of the Zoning Bylaws to raze a pre-existing, nonconforming single-family dwelling and <br /> replace it with a new single-family dwelling on property located in an R-3 Zoning District, Map <br /> 119 Parcel 81, Mashpee, MA. (Continued from December 13, 2023 hearings at the request of <br /> the Attorney). <br /> Mr. Bonvie and Mr. Furbush stepped down from this hearing. <br /> Sitting on this hearing is Ms. Sangeleer, as Acting Chair along with members Mr. Blaisdell, Mr. <br /> Goldstein, Mr. Ganzenmuller, and Mr. Reidy. <br /> Attorney Christopher Kirrane represented this petition,and requested a continuance because it will <br /> be presented at the Conservation Commission hearings dated Thursday, March 7, 2024. <br /> Mr. Reidy made a motion that the Board agree to continue 29 Riverside Road until March 13, <br /> 2024. Mr. Ganzenmuller, second. All were in favor. <br /> 90 Popponesset Island Road: Owner, Brendon P. Giblin requests a Special Permit under §174- <br /> 17.1 and§174-33 of the Zoning Bylaws to raze a pre-existing,nonconforming residential structure, <br /> and replace it with a new single family residential structure with associated pool and detached <br /> garage with guest suite above on property located in an R-3 Zoning District, Map 106 Parcel 34, <br /> Mashpee, MA. (Continued from December 13, 2023 hearings at the request of the Attorney). <br /> Sitting on this hearing are the five regular Board members. <br /> Attorney Christopher Kirrane represented the homeowners for this Special Permit request. Also <br /> present was Mark Dibb with Cape& Islands Engineering. Attorney Kirrane provided revised site <br /> plan,house design plans, and a written narrative with photos of other house project developments <br /> in the immediate neighborhood. <br /> This is a request for a Special Permit under Sections 174-17.1 and 174-33.This property is located <br /> in the R-3 Zoning District which requires a minimum lot area of 40,000 sq. ft. and 150 ft., <br /> minimum frontage. The lot is nonconforming although it has the minimum required frontage and <br /> because it is wholly in the flood zone does not have the minimum lot area as defined by the Zoning <br /> Bylaw. There is 20,421 ft. of upland area but for zoning purposes it has zero sq. ft. <br /> 5 <br />
