MASH.PEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> JULY 279 2022 <br /> NEW HEARINGS <br /> Sitting on this hearing are the three regular Board members, Ms. Sangeleer, and Mr. Pittsley. <br /> 68 Mercantile , Petitioner,, Daniel Hostetter requests a Special Permit under §174-24 <br /> {C), and §174-25 (G) (1.4) of the Zoning Bylaws to allow for construction of a 9,972 sq. ft. <br /> metal building with contractor bays on property located in the I-I and Light Industrial Overlay <br /> District, Map 88 Parcel 91, Mashpee, MA (Owners of Record: Timothy E. and Cheryle R. <br /> Tuttle,Trustees). <br /> Attorney, Christopher Kirrane represented the applicant for the Special Permit request to <br /> construct a 9,972 sq. ft. Morton style building situated on a 143,346 sq.. ft. lot with 332 feet of <br /> frontage on Mercantile Way that is located in the I-I and Light Industrial Overlay Districts. The <br /> building will be divided into eight contractor bays. There are no other requests associated with <br /> this proposal. The building will.meet all setback and lot coverage requirements.There are eleven. <br /> Q I)proposed parking spaces and one handicap space that is required under the bylaw. <br /> Attorney- Kirrane submitted a letter dated July 20, 2022 addressing the Site Plan Review <br /> comments that were discussed at the Committee Meeting dated June 7,2022. The first item was <br /> that a Fire Suppression Plan be submitted at the time of the building permit application. The <br /> Board of Health approved the septic design plan as indicated in the letter. Attorney Kirrane said <br /> that if there are any 'intended uses for the contractor bays, a proposal would be required to be <br /> submitted to the Board of Health, and the Zoning Board. <br /> Mr.Bonvie asked if there will be parking outside the contractor bays.Attorney Kirrane said there <br /> are no specific uses proposed for this building at this time. Generally, any Special Permit use <br /> will require a proposal.to this Board. Mr.Bonvie wanted clarification if there were a landscaping <br /> company utilizing the lot for screening material,al, etc. Attorney Kirrane said that a contractor <br /> would require a proposal to the Zoning Board. The bylaw specifically defines a contractor's yard <br /> and a contractor's bay. <br /> Mr. Joao Junquelra, with Capewide Construction said that contractor bays have parking spaces <br /> for each bay,for example a,contractor can park a vehicle outside of their own bay,but the bylaw <br /> does not allow any mulch stored outside, or any machine powered trucks doing any production <br /> unless a Special Permit is approved by the Zoning Board for a contractor's yard. <br /> Ms. Sangeleer read the Board of Health letter dated July 18, 2022 into the record. <br /> Mr. Richard Boyden, 16 Sugar Pine Circle. He had specific questions for the Board regarding <br /> the wooded buffer between.his lot and the subject lot. He asked if the petitioner plans to clear <br /> cut to its maximum allowed area. He asked if the petitioner does plan to clear the lot would he <br /> consider adding an,additional 5 0-75 ft.forested area on the North side in addition to the mandated <br /> 125 ft. setback for a total of 175-200 ft. If the petitioner does plan to clear cut this lot to its <br /> maximum.would he provide an additional forested tree buffer? <br />
