MA.SHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> DULY 279 2022 <br /> Mr. Gould seconded, yes <br /> Ms. Sangeleer,yes <br /> Mr. Pittsley, yes <br /> Mr. Goldstein,yes <br /> Mr. Bonvie yes. <br /> All were in favor of the Special Permit. <br /> ADDITIONALIOPICS <br /> (This space is reserved for topics that the Chairman did not reasonably anticipate would be discussed.) <br /> Mr. Bonvie asked the audience if they had any additional topics to discuss. <br /> Mr.Joao Jun.queira with Capewide Construction requested a discussion regarding 79 Echo Road, <br /> and provided the Board with a GIS map of the property. Mr. Junquelra mentioned that this lot <br /> has a deep hole filled with scrub pines,and he would like to remove the scrub pines for now and <br /> fill in the hole. He mentioned that he has a customer that will be applying with the ZBA to <br /> construct a building on this lot for a flooring business. <br /> Mr. Bonvie asked Mr.Morris if there are any guidelines that he is required to follow. Mr. Morris <br /> said that there has been a lot of clearing in that area, and the Conservation Agent may have a <br /> comment. There is no issue. <br /> Mr. Bonvie mentioned that there is no Zoning 'involved,and thanked him for his time. <br /> OTHER BUSINESS <br /> Approve July 13,2022 Meeting Minutes <br /> Ms. Sangeleer moved to approve the Meeting Minutes dated July 13,2022. Mr. Gould seconded. <br /> All were in favor. <br /> EXECUTIVE SESSION <br /> 1'o discuss strategy with respect to pending litigation in the matter of BEC MA Properties, L1,C <br /> v. Maslipee ZBA; Barnstable Superior Court C.A. No. 22CV 191 pursuant to G.L. c. 30.A., <br /> At approximately 7:32 pm, Mr. Goldstein made a motion, and moved that the Board convene in <br /> executive session pursuant to G.L. c. 3 OA, §21(a) 3)to discuss strategy with respect to pending <br /> litigation.l.n.the matter of BEE MA Properties, LLC v.Mashpee ZBA.;Barnstable Superior Court <br /> C.A. No. 22CV 191, with.the Chair having declared that sueb a discussion in an open meeting <br /> may have a detrimental. effect on the Board's litigating position.. The Board will not reconvene <br /> in open.session,upon.conclusion.of the executive session.. <br /> 7 <br />
