Gould, Associate Members, Sharon Sangeleer, George
Ganzenmuller, and Bob Caggiano were present. Also present was David Morris, Building
Commissioner and Chris Gallagher, Town Engineer.
PLEDGE of ALLEGIANCE
Chairman Furbush opened the meeting at 6:oo pm and announced that the hearings were
being televised live on Mashpee TV as a hybrid/virtual/remote meeting. He will take
comments after each hearing.
NEW HEARINGS
Sitting on these hearings are the five regular Board members.
18 Wilsons Grove: Owners, Laurie and Joseph Mancinelli request a Special Permit under
§174-17.1 of the Zoning Bylaws to raze and replace a single story, three bedroom dwelling
and replace it with a new non-conforming code compliant three bedroom home on property
located in the Popponesset overlay District and R-3 Zoning District, Map 118 Parcel 72,
Mashpee, MA.
18 Wilsons Grove: Owners,Laurie and Joseph Mancinelli request a Variance under§174-
31 of the Zoning Bylaws to vary the height requirement to allow for the raze and replace
of a single family residence on property located in the Popponesset Overlay District and
R-3 Zoning District, Map 118 Parcel 72, Mashpee, MA.
Attorney,Kevin Kirrane represented the homeowners for the two petition requests. He took
note of the various information submitted by the Town Department Heads that were in the
file suggesting that the height Variance is something that should not be granted. He had a
discussion with his clients' months ago, and notwithstanding the fact that he believes that
there is a rational basis to ask for that relief, it would mare no sense given those comments
that were made by the various Department Heads in connection with the Variance request
for the height of the building. He asked his clients to revisit the design of the structure so
that it conforms to the 30 ft.height restriction that is applicable in the overlay District, and
requested that this matter be continued to Wednesday, February 9, 2022, at which time he
hopes to have that revised plan so at that time he could withdraw the request for Variance
relief.
1
