MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> FEBRUARY 14, 2024 <br /> Chairman Bonvie asked for a motion to accept the continuance. Mr. Blaisdell, so moved. Mr. <br /> Furbush, second. All were in favor. <br /> 57 Duck Blind Road; Owners,Patricia A.Marks and Andrew G.Marks request a Written Finding <br /> under §174-17 of the Zoning Bylaws to allow for construction of a 67 sq. ft. addition, and a 62 sq. <br /> ft. addition to a pre-existing,nonconforming single-family dwelling on property located in an R-5 <br /> Zoning District, Map 57 Parcel 49, Mashpee, MA. <br /> Attorney Kirrane represented Patricia and Andrew Marks who are requesting two modest additions <br /> to their existing dwelling. The property consists of 71,000 sq. ft., is nonconforming, and requires <br /> 80,000 sq. ft. in the R-5 Zoning District. The existing structure has two non-conformities as if fails <br /> to meet the northeasterly side yard setback. The existing dwelling is 5 ft. 2' from the side yard <br /> setback where 15 ft. is required,and it is 40 ft. from the inland bank that is within the 50 ft. setback <br /> from the wetlands. <br /> The proposal consists of a 62 sq. ft. addition to the front of the house that will conform to all <br /> setback requirements. The 67 sq. ft. addition will be 10.2 ft. from the property line,and will remain <br /> nonconforming with the existing structure, but will not be any closer than what currently exists at <br /> 5.2 ft.There is an existing paver patio area,and the addition will not intensify this already disturbed <br /> section of the dwelling. The proposed lot coverage is 1.8%and is well under the 20%requirement. <br /> This project will not be substantially more detrimental than what currently exists, and there is <br /> adequate parking as required. <br /> Mr. Reidy read the Board of Health comments dated February 8, 2024 into the record; o increase <br /> inflow, to remain two bedroom. ",and the Building Department comments dated February 6,2024 <br /> into the record; "No issues. "and the Conservation Department comments dated February 12,2024 <br /> into the record,"I provided administrative approval for the additions to the home at 57 Duck Blind. <br /> They are all set with Conservation. " <br /> Chairman Bonvie asked for any comments from the audience.A direct abutter addressed the Board <br /> and has no issues with the project. There were no more comments. <br /> Chairman Bonvie asked for a motion to close the public hearings. Mr. Blaisdell, so moved. All <br /> were in favor to close the public hearings. <br /> Chairman Bonvie asked for a motion on the application. <br /> Mr. Reidy made a motion regarding the application for 57 Duck Blind Road for Owners, Patricia <br /> A. Marks and Andrew G. Marks requesting a Written Finding under §174-17 and §174-33 of the <br /> Zoning Bylaws to allow for construction of a 67 sq. ft. addition, and a 62 sq. ft. addition to a pre- <br /> existing, nonconforming single-family dwelling on property located in an R-5 Zoning District, <br /> Map 57 Parcel 49,Mashpee, MA with the following conditions: <br /> 6 <br />
