MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> MARCH 13,2024 <br /> Mr. Reidy made a motion that the Board issue a Special Permit to Owners, Russell L. and Anne <br /> E. Spencer under §174-17.1 of the Zoning Bylaws to raze a pre-existing, nonconforming single- <br /> family dwelling and replace it with a new single-family dwelling on property located in an R-3 <br /> Zoning District, Map 119 Parcel 81, Mashpee, MA with the following conditions: <br /> 1. The Board has determined that the applicant meets all the conditions of a Special Permit <br /> under Mass General Law 40A Section 9. <br /> 2. Site Plan - 29 Riverside Road, Mashpee, MA. Prepared for: Russell and Anne Spencer, <br /> Scale: 1" = 20', Date: Oct. 25, 2023, Job number: 23035, Revisions: Added Setback <br /> Dimensions to Existing House, Noted Areas of Non-Compliance of Proposed House, <br /> Clarified Coverage Note 4, by TJB dated Dec. 1, 2023, Drawing Number: B22-91, <br /> Prepared by: BSS Design Engineering & Surveying. <br /> 3. Building Plans Date: 10/26/23— 29 Riverside Rd., Front and Left Elevation — Proposed <br /> Detached Garage. Second Floor Plan — Proposed Detached Garage, Front Elevation — <br /> Proposed House,First Floor Plan—Proposed House, Second Floor Plan--Proposed House. <br /> First Floor Plan, Proposed Detached Garage. <br /> 4. Conditioned on all Town Department comments read into the record including but not <br /> limited to the DPW Director, Conservation Dept. and Board of Health comments. <br /> 5. Conditioned that the ADU be applied for under a separate building permit application. <br /> 6. Any changes to the plans will require the applicant to return to this Board. <br /> 7. Having reviewed and aware of the comments and opinions submitted by Evan Lehrer, <br /> Town Planner under the two submissions both prior to and after the Conservation <br /> Department ruling. <br /> 8. The Board finds that the application as submitted under §174-17.1 and §174-33 is not <br /> substantially more detrimental than what existed prior to removal of the existing structure, <br /> and that there is adequate land area to provide sufficient parking, and there are no new <br /> nonconformities being created. <br /> Mr. Blaisdell, second <br /> Mr. Goldstein, yes, <br /> Mr. Reidy, yes, <br /> Mr. Caggiano, yes, <br /> Ms. Sangeleer, yes. <br /> All were in favor to issue a Special Permit. <br /> 6 <br />
