MASHPEE ZONING BOARD OF APPEALS <br />MEETING MINUTES <br />DECEMBER 13, 2023 <br />Attorney Christopher Kirrane represented the homeowners for 29 Riverside Road. He requested a <br />continuance until January 24, 2024 for two reasons; one because there are only four voting <br />members, and the other reason is because there is conflicting information that Conservation does <br />have jurisdiction to review this project and based on the Board's policy that they have those <br />approvals before this hearing. <br />Mr. Furbush stepped down from this hearing. <br />Mr. Reidy made a motion relative to 29 Riverside Road to continue the hearing until January 24, <br />2024 with new information and a revised plan to be presented to the Board. Mr. Ganzenmuller <br />second. All were in favor. <br />90 Po )onesset Island Road: Owner, Brendon P. Giblin requests a Special Permit under § 174- <br />17.1 of the Zoning Bylaws to raze a pre-existing, nonconforming residential structure, and replace <br />it with a new single family residential structure with associated pool and detached garage with <br />guest suite above on property located in an R-3 Zoning District, Map 106 Parcel 34, Mashpee, <br />MA. <br />Attorney Christopher Kirrane asked for a continuance because this matter is under review with <br />Massachusetts DEP, who provided an email that any information will take at least 30-days to be <br />issued. <br />Mr. Reidy made a motion that the Board accept a continuance until January 24, 2024 in anticipation <br />of receiving new information to be presented to the Board. Mr. Ganzenmuller second. All were in <br />favor. <br />37 Nick Trail: Owners, Brian J. and Karen F. Kelleher request a Variance from § 174-31 special <br />footnote 12 of the Zoning Bylaws to allow for separation of a merged lot shown on assessors Map <br />117, Parcel 300 and located in both the R-3 and Popponesset Overlay Districts, Map 117 Parcel <br />300, Mashpee, MA. <br />Mr. Furbush is stepping down from this hearing. <br />Mr. Ganzenmuller asked the Chair why Mr. Furbush left the room. Mr. Bonvie stated that if a <br />Board member feels that they are in conflict with the hearing they can step down from that hearing. <br />Attorney Christopher Kirrane requested a continuance until January 24, 2024 so it can be presented <br />in front of five members. <br />Mr. Reidy made a motion relative to 37 Nick Trail to be continued until January 24, 2024. Mr. <br />Ganzenmuller, second. All were in favor. <br />
