MASHPEE ZONING BOARD OF APPEALS <br />MEETING MINUTES <br />DECEMBER 13, 2023 <br />29 Echo Road and 41 Echo Road: Petitioner, 3M Ventures, Inc., d/b/a Triple M Management <br />Company, LLC requests a modification under § 174-24 (C) (9) (c) (e) of the Zoning Bylaws, and <br />condition #5 of the Special Permit Decisions: SP-2015-33; SP-2019-36; SP-2020-28; MOD- <br />2023-08 to extend the date for completion of construction from its previously extended date of <br />December 31, 2023 to May 31, 2024 on property located in the I-1 and Light Industrial Overlay <br />Zoning Districts, Map 19 Parcels 3-8 and 3-9, Mashpee, MA. (Owner of record: Triple M. <br />Management Company, LLC.). <br />Attorney Christopher Kirrane represented the Petitioner, 3M Ventures. This is a request for an <br />extension of the existing Special Permit to May 31, 2024. The Board may recall that this matter <br />was before them six months ago and the Board allowed an extension until December 31, 2023. <br />There were some concerns raised by the Fire Department, and the Board allowed the extension <br />until this date knowing his client has consulted with the Fire Department. <br />Attorney Kirrane said his client has consulted with the Fire Department but he has not heard that <br />they had any concerns. Mr. Kirrane provided the Board with a progress report and an estimated <br />timeline of the projected work to be performed. <br />Mr. Bonvie had concerns with what the Fire Department had presented, and the issues that Mr. <br />Morris had. <br />Mr. Reidy read the comments submitted by Catherine Laurent, DPW Director dated November <br />29, 2023: Echo Road is a Town road. While the original project did receive a Cub Cut Permit <br />from the DPW, this permit has expired. Since then, an issue has arisen with the turning radius for <br />the driveway aprons. The radius is too short/abrupt so vehicles and large trucks entering or exiting <br />the property "cut the corner". This is causing a 'pothole "at each corner and will eventually break <br />down the edge of pavement for Echo Road. I request that any approved extension be conditioned <br />upon the widening of the paved turning radius for each entrance and exit for the properties within <br />the next six months. <br />Attorney Kirrane stated that if the Board is willing to extend the time of completion until January <br />31, 2024, he will agree to continue the hearing until January 24, 2024. The procedure would require <br />a new application extension from January 31, 2024 to May 31, 2024 because the Board is granting <br />a modification from "X" date, and another modification would be required. <br />Mr. Bonvie is willing to accept a continuance as long as the Board has definitive comments from <br />the Fire Department and Mr. Morris, Building Commissioner. He said he can work with the <br />Attorney on the procedure. <br />Attorney Kirrane asked for an extension of the completion date of Condition 5 of the existing <br />Special Permit until January 31, 2024. <br />
