SEPTEMBER 13,2023 <br /> MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> Attorney Kirrane provided his written presentation detailing the proposed improvements that <br /> consist of; <br /> a. Remove front stairs and decking and enclose the front entrance. <br /> b. Repair and/or replace the decks in on the southerly side of the house and add a rinse station <br /> below. <br /> c. Remove the deck around the pool area and replace it with a patio. <br /> d. Adding a deck and stairs to the northerly side of the house; and <br /> e. Remove the existing stairs and land on the northerly side of the home. <br /> Attorney Kirrane stated that there is no increase in the setbacks and no new non-conformities being <br /> created. The structure coverage is decreasing from 11.67%to 10.5% and is noted on the site plan. <br /> The proposed changes, alterations, or expansion will not result in a condition that is substantially <br /> more detrimental than the existing non-forming structure to the neighborhood, and there is <br /> adequate land area to provide enough parking as maybe required. <br /> Mr. Reidy read the Board of Health comments dated September 7, 2023 into the record; "No <br /> increase in bedrooms to remain (4) bedrooms, no comment. " The Conservation Department <br /> comments dated September 7, 2023 into the record; "Notice of intent permit application for <br /> alterations to existing house and pool patio approved at the August 24`h hearing. " <br /> Attorney Kirrane said that the improvements are exterior only. There is no increase in bedrooms. <br /> Mr. Morris stated that any discrepancies with the Building Department can be reviewed during the <br /> permitting process. <br /> Mr. Goldstein reviewed the building plans, and there was no issues with egress requirements. <br /> There were no comments from the audience, and no more comments from the Board. <br /> Chairman Bonvie asked for a motion to close the public comments. Mr. Reidy, so moved. Mr. <br /> Blaisdell second. All were in favor. <br /> Mr. Reidy made a motion that the Board issue a Written Finding to Owners, Michael J. and <br /> Maureen G. Tringale, Trustees under §174-17 and §174-33 of the Zoning Bylaws to allow for a <br /> deck reconstruction, extension, and alterations to a pre-existing, non-conforming structure on <br /> property located in an R-3 Zoning District,Map 120 Parcel 134,Mashpee, MA with the following <br /> conditions: <br /> 1. The Board has determined that the applicant meets all the conditions of a Written Finding <br /> under Mass General Law 40A Section 6. <br /> 2 <br />
