Gildea requesting a <br /> Special Permit under §174-17.1 of the Zoning Bylaws to raze and replace a pre-existing, non- <br /> conforming single family structure on property located in an R-3 and Popponesset Overlay <br /> District(s), Map 112 Parcel 49,Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. <br /> Notice was given by publication in The Mashpee Enterprise, a newspaper of general circulation in <br /> the Town of Mashpee,on September 11,2023 and September 18,2023 a copy of which is attached <br /> hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br /> Massachusetts General Laws Chapter 40A §9 and the Town of Mashpee Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on Wednesday, September <br /> 13, 2023 at which time the following members of the Board of Appeals were present and acting <br /> throughout; Chairman, Ron Bonvie, Board Member, William Blaisdell, and Associate Members, <br /> Charles Reidy, Bradford Pittsley, and Robert Caggiano. <br /> Attorney Christopher Kirrane represented Owners, Mr. Peter Frick and Ms. Tara Gildea who were <br /> also present are requesting a Special Permit to a raze and replace their existing 60-plus year old, <br /> single family residential structure under Section 174-17.1. <br /> As indicated in Attorney Kirrane's written presentation, the property is located in the Popponesset <br /> Overlay District. The lot consists of 11,938 sq. ft. of land with 34.38 ft. of frontage along Wading <br /> Place Road, and 88 ft. of frontage along Shore Drive. The lot meets the minimum requirements <br /> for lot size and frontage in the Popponesset Overlay District. <br /> There are no setback to wetlands issues, and no flood zone issues. The only non-conformity is the <br /> 12 ft. setback between the ancient way and the exiting dwelling; the setback requirement is 40 ft. <br /> Otherwise, the structure complies with all other dimensional requirements. <br /> 1 <br />
