MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A SPECIAL PERMIT <br /> Owners, Peter R. Frick and Tara A. Gildea <br /> 194 Wading Place Road, Map 112 Parcel 49 <br /> Mashpee, MA 02649 <br /> SP-2023-52 <br /> The proposal consists of a modest three bedroom,one and one-half story structure,and will include <br /> an installation of a new IA septic system. The lot coverage will increase from 14.56% to 16.99% <br /> which is well under the 25%requirement in the Popponesset Overlay District. <br /> Attorney Kirrane concluded that the redevelopment will not result in a condition that is <br /> substantially more detrimental than what currently exists, as follows: <br /> a. New construction will become building code compliant. <br /> b. A new IA septic system is being installed. <br /> c. There are no new non-conformities being created. <br /> d. The lot coverage will be under the maximum allowed 25%. <br /> e. Drywells are proposed to capture any water runoff onsite. <br /> f. The proposal is consistent with the redevelopment in the neighborhood. <br /> GENERAL FINDINGS <br /> The subject property located at 194 Wading Place Road consists of 11,398 square feet of land. The <br /> minimum dimensional requirements in the Popponesset Overlay District are as follows: <br /> Minimum lot size—6,000 square feet. <br /> Minimum frontage—60 feet <br /> Minimum Front Yard Setback—25 feet <br /> Minimum Side and Rear Yard Setbacks— 15 feet. <br /> Mr. Reidy read the Board of Health comment dated September 7, 2023 into the record; "Storage" <br /> space on first floor must remain unfinished to not be considered a bedroom." The Conservation <br /> Department continent was read into the record; "Property is not in Conservation jurisdiction. " <br /> Attorney Kirrane stated for the record that he spoke to the Health Agent, and the plan was revised <br /> to depict the 6 ft. cased opening of the storage space. <br /> Mr. Reidy read an email into the record dated September 13,2023 from John Molloy a resident of <br /> 196 Wading Place Road stating he is in favor of the project." <br /> SPECIAL PERMIT CRITERIA <br /> ARTICLE V -Nonconforming Buildings and Uses <br /> §174-17.1 Raze and Replace History:Added 10-15-2018 ATM,Article 16,approved by Attorney <br /> General 1-9-2019. <br /> 2 <br />
