Monroe <br />9 Woodland Avenue <br />Map 49, Parcel 98 <br />Mashpee, MA 02649 <br />Bk.: 2081 <br />Pg.: Ill <br />A Petition was filed on August 30, 2023 by Owners, Richard N. and Theresa G. Monroe requesting <br />a Written Finding under § 174-17 of the Zoning Bylaws to allow for a deck reconstruction, a three <br />season porch addition, and extension over an existing garage to a pre-existing, non -conforming <br />structure on property located an R-5 Zoning District, Map 49 Parcel 98, Mashpee, MA. <br />Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. <br />Notice was given by publication in The Mashpee Enterprise, a newspaper of general circulation in <br />the Town of Mashpee, on September 22, 2023 and September 29, 2023 a copy of which is attached <br />hereto and made a part hereof. <br />The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br />Massachusetts General Laws Chapter 40A §6 and the Town of Mashpee Zoning By-laws. <br />Public Hearings were held on the Petition at the Mashpee Town Hall on Wednesday, October 11, <br />2023 and continued to Wednesday, October 25, 2023 at which time the following members of the <br />Board of Appeals were present and acting throughout; Chairman, Ronald Bonvie, Board Members, <br />Sharon Sangeleer, Jonathan Furbush, Scott Goldstein, and Associate Member, Robert Caggiano. <br />At the public hearings on October 11, 2023, the homeowners presented their Written Finding <br />application to re -construct the existing deck with a three season porch. Also present was Tom <br />Griffin, Contractor for the project. The existing house is pre-existing, non -confirming. The existing <br />deck was originally built at an angle and does not meet their current needs. The site plan and <br />building plans depicted the proposed extension for the deck project. The addition indicated a <br />setback of 10.7 ft. from the side yard which is no more non -conforming than the existing dimension <br />at 10.6 ft. <br />Mr. Richard Monroe stated that the hearing was postponed because the Board wanted to get <br />clarification regarding the comments submitted by Catherine Laurent, DPW Director. Mr. Monroe <br />had a conversation with Ms. Laurent after the last meeting, and suggested that drywells be installed <br />for the roof runoff. <br />
