MASHPEE ZONING BOARD OF APPEALS <br />DECISION FOR A WRITTEN FINDING <br />Richard N. Monroe and Theresa G. Monroe <br />9 Woodland Avenue, Map 49 Parcel 98 <br />Mashpee, MA 02649 <br />FINDING-2023-56 <br />GENERAL FINDINGS <br />The comments submitted on October 11, 2023 from Catherine Laurent, DPW Director; "RE: 9 <br />Woodland Avenue. DPW is requesting that a condition of any approval be imposed requiring that <br />the property owner install drywells on their existing dwelling as well as any addition to contain <br />storm water runoff on their property. After receiving a complaint this summer from the adjacent <br />property owner (264 Hooppole Road) about flooding in his back yard, DPW investigated and <br />found evidence of .storm water runoff from 9 Woodland Ave flowing down the applicants` <br />driveways, along the backside of the road berm, and into the neighbor's backyard Attached is a <br />photo taken last week showing the "ravine" created in one of the driveways by the storm water <br />from their roof downspout. " <br />An email dated October 4, 2023 from Jeanne Siwik was read into the record, and is in favor of the <br />project. <br />The Board of Health comments dated October 6, 2023 were read into the record; "No comment, <br />no increase in habitable space. " The Conservation Department comments dated October 18, 2023 <br />were read into the record; "No wetlands jurisdiction. " <br />Ms. Sangeleer read an email from Catherine Laurent, DPW Director dated October 13, 2023 into <br />the record; "As stated in the email from Richard Monroe, he and I spoke yesterday. He is in <br />agreement to install drywells for his roof runoff " <br />The Board had no more comments and was satisfied with the DPW Director revised comments. <br />WRITTEN FINDING CRITERIA <br />ARTICLE V - Nonconforming Buildings and Uses: <br />§174-17. Continuance; Extensions; Alterations - Lawfully created structures or uses may be <br />continued, although not conforming with the provisions of this chapter. <br />Non -conforming single- or two-family dwelling structures may be changed, extended or altered if <br />such change, extension or alteration complies with the dimensional requirements applicable to the <br />lot under current provisions of § 174-31 or, for lots which have been developed pursuant to § 174- <br />21, complies with such requirements as were applicable to initial construction of the dwelling <br />under provisions of § 174-21. <br />
