Pg.: 293 <br /> 50 Evergreen Circle <br /> Map 19, Parcel 10-5 <br /> Mashpee, MA 02649 <br /> A Petition was filed on September 5, 2023 by Owner, Chapter Closed LLC requesting a Special <br /> Permit under §174-25; §174-25 (G) (14); §174-24 (C) (2); §174-45.6; §174-37, and §174-41 (M) <br /> of the Zoning Bylaws to allow for construction of 9,672 sq. ft. contractor bay warehouse metal <br /> building on property located in the I-1 and Light Industrial Overlay District, at 50 Evergreen <br /> Circle, Map 19, Parcel 10-5, Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. <br /> Notice was given by publication in The Mashpee Enterprise, a newspaper of general circulation in <br /> the Town of Mashpee, on September 29, 2023 and October 6, 2023 a copy of which is attached <br /> hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br /> Massachusetts General Laws Chapter 40A §9 and the Town of Mashpee Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on Wednesday,at which time <br /> the following members of the Board of Appeals were present and acting throughout;Acting Chair, <br /> Sharon Sangeleer, Board Members, Jonathan Furbush, William A. Blaisdell, Scott Goldstein, and <br /> Charles Reidy. Also present was David Morris, Building Commissioner. <br /> Attorney Christopher Kirrane represented the Pastore Excavation Inc. who is seeking a Special <br /> Permit to construct a 9,672 sq. ft. building consisting of eight contractor bays, and relief from the <br /> parking requirements under the zoning bylaws. Also present was Mark Dibb,with Cape& Islands <br /> Engineering. This project was presented on September 19, 2023 to the Plan Review and Design <br /> Review Committees, and their recommendations have been incorporated in the design plan. This <br /> project has also been reviewed by Mr. Ed Pesce,Pesce Engineering who represented the Board for <br /> peer review of the engineering plans, site plans, landscape plans, and photometric plan. <br /> The site consists of 110,664 sq. ft. and has 128 ft. of frontage along Evergreen Circle. The building <br /> is a Morton style design building that will comply with current zoning. The Board can make a <br /> finding as indicated under Section 174-24, that the proposed use and development will not <br /> adversely affect public health or safety, will not cause excessive demand upon community <br /> 1 <br />
