Spencer requesting a Special Permit under §174-17.1 and §174-33 of the Zoning Bylaws <br /> to raze a pre-existing, non-conforming single-family dwelling, and replace it with a new single- <br /> family dwelling on property located in an R-3 Zoning District, at 29 Riverside Road, Map 119 <br /> Parcel 81, Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. <br /> Notice was given by publication in The Mashpee Enterprise,a newspaper of general circulation in <br /> the Town of Mashpee,on November 10,2023 and November 17,2023 a copy of which is attached <br /> hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br /> Massachusetts General Laws Chapter 40A §9 and the Town of Mashpee Zoning By-laws. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on Wednesday, March 13, <br /> 2024 at which time the following members of the Board of Appeals were present and acting <br /> throughout;Acting Chair, Sharon Sangeleer, William A.Blaisdell, Scott Goldstein,and Associate <br /> Members, Charles Reidy, and Robert Caggiano. Also present was David Morris, Building <br /> Commissioner. <br /> Attorney Christopher Kirrane represented Russell and Anne Spencer, Owners of 29 Riverside <br /> Road located on Seconsett Island. Also present was Tom Bunker, Project Engineer with BSS <br /> Design. The Owners are requesting a Special Permit under§174-17.1 and §174-33 to a raze a pre- <br /> exiting, non-conforming two (2) bedroom house, and replace it with a single-family dwelling and <br /> a detached garage located in the R-3 Zoning District. <br /> 1 <br />
