Motion made by Ms. Godfrey to close and issue with the following conditions: the <br />inclusion of 1,032 sqft of mitigation plantings to be finalized with staff, removal of the putting <br />green, removal of invasive species, and implementation of a 2-year mitigation monitoring and <br />maintenance contract between the property owner and a qualified professional. This motion is <br />seconded by Ms. Copeland. <br /> ROLL CALL: Ms. Godfrey (Yes), Ms. Thornbrugh (Yes), Ms. Clapprood (Yes), <br />Ms. Copeland (Yes) Ms. Zollo (Yes). <br /> <br />The motion passes unanimously. <br /> <br />7:03 <br />NOI 43-3264 <br /> 279 Monomoscoy Rd, CS Realty Trust. Proposed raze and replace of existing <br />single family home, proposed garage, shed, landscaping, walkway to existing dock, and mitigation <br />plantings. Rep: Cauley Site Services, LLC (Cont. 1/11, 3/7, 3/21) <br /> Resource Area: LSCF, buffer zone to the top of coastal bank, land under <br />ocean, and ACEC (area of critical environmental concern). <br /> Attorney Wall, representing the applicants, provides an overview of the dwelling <br />and site on Hamblin Pond, describing it as "highly disturbed" with overgrown plantings and <br />extending lawn to the seawall's edge. He notes its location in a coastal storm flow zone and its <br />non-compliance with current flood standards. He highlights revisions to the plan, including pulling <br />the new dwelling farther from the wetland, removing the raised patio and stairs, and shifting the <br />barn away from resources. Mitigation plantings have been recalculated to exceed requirements, <br />with additional restoration for invasive species management. The proposed dwelling will be <br />setback further from the seawall and elevated above the floodplain, with flood vents in the <br />foundation. The barn will have a similar foundation and be detached. Gravel areas in the <br />foundation design consider flood potential. An upgraded denitrifying septic system with pressure <br />dosing will be installed. Attorney Wall addresses Regulation 25, arguing it doesn't apply as the <br />property is not in a velocity zone but in an AE flood zone with moderate wave action. He cites a <br />coastal geologist's letter supporting this interpretation. He also questions the applicability of <br />Regulation 25 C7C on setbacks to wetlands, suggesting it's meant for critical erosion areas. Despite <br />town council's view, he requests the commissioners consider maintaining zoning setback <br />requirements as they currently stand. <br /> <br />Ms. Zollo addresses Attorney Wall's argument regarding the inapplicability of Regulation 25 <br />C7C, noting that historically, the regulation has not been enforced by the Town of Mashpee. She <br />highlights the town has begun consistent enforcement of Regulation 25 C7C waivers for all <br />applicants and confirms that this practice will continue.
