The Board finds under §174-17 and §174-33 that the proposed elevated boardwalk and <br /> stairs is not substantially more detrimental than the pre-existing, non-conforming <br /> structure to the Town or the neighborhood. <br /> Mr. Furbush, second <br /> Mr. Reidy, yes, <br /> Mr. Ganzenmuller, yes <br /> Mr. Blaisdell, yes, <br /> Ms. Sangeleer, yes. <br /> All were in favor to issue a Written Finding. <br /> OTHER BUSINESS <br /> 5 Shore Drive: Attorney, Christopher Kirrane on behalf of his clients Owners, Desmond and Joan <br /> Kelly, requests approval of an architectural design change pursuant to §174-24 (C) (9) (a) of the <br /> Zoning Bylaws. (Received a Special Permit under§174-17.1 - SP-2023-11). <br /> Attorney Christopher Kirrane represented the homeowners of the property on 5 Shore Drive. This <br /> application was a raze and replace that was approved by the Board last year. He submitted a letter <br /> dated March 27, 2024 that included photos and minor architectural design changes that depict <br /> screened panels, and his client is requesting to replace the panels with windows. There are no <br /> changes to the footprint or setbacks of the structure. <br /> Mr. Reidy read the Building Commissioner's comment dated April 4, 2024 into the record; `No <br /> issues with the design change. " <br /> There were no more comments from the Board or audience. <br /> 3 <br />
