Agent: The system consists of pipes and stone with vents, allowing for 36 inches of soil
above. There are no issues with groundwater separation, especially since it is a fast system
equipped with a UV disinfectant for fecal matter, considering the property's proximity—within
1000 feet and 75 feet— to the waterway. He emphasizes that the 5.5-foot slope is temporary and
will be removed.
Motion made by Mr. Livingston for approval. Seconded by Mr. Raposa.
Roll Call: Mr. Livingston (Yes), Mr. Raposa (Yes), Mr. Virgilio (Yes).
Motion passed unanimously.
3. Review of request of variance from local regulation – 45 Seconset Point Road, Pete
McEntee – Engineering Works
i. The existing dwelling consists of 1 bedroom, with the current system
being unknown. It’s emphasized that there is currently a metal
tank/drum inground, which will be removed. The proposal is for a
new septic system with a sledgehammer to treat nitrogen. A variance
request has been made to achieve maximum feasible compliance
given the existing site constraints. This variance pertains to local
regulations—Part IX, Section 9.0, Leaching Distance Requirements.
ii. 23ft variance, S.A.S to watercourse, for a 77ft setback.
The agent states that this represents maximally feasible compliance without requiring any
Title V variance. It’s highlighted that, due to the location of the property, a variance would be
required regardless. He ensures that this system is more beneficial to the area, as a different
system would produce runoff and adversely impact the resource areas.
Motion made by Mr. Livingston for approval. Seconded by Mr. Raposa.
Roll Call: Mr. Livingston (Yes), Mr. Raposa (Yes), Mr. Virgilio (Yes).
Motion passed unanimously.
4. Review of request of variance for sale without septic repair, 56 Brewster Rd, Cindy
Crawford
a. The current septic system has failed, with leaching field staining located in
phase 1 of the town sewer program. The proposal is to have the leaching
field pumped out immediately and again until the property can be connected
to the town sewer.
Agent: Recommends, for approval, pumping before the sale and another in 6 months.
This will be pending until a signed agreement from both the seller and buyer has been
submitted to the Board of Health. The agent emphasizes that should there be any
complaints of sewerage rising from the ground prior to the town sewer hookup, the Board
of Health will revisit the variance and determine a resolution at that time.
The Board confirms that a receipt from pumping will be required for
confirmation. The Agent ensures that this is an automatic requirement by the Town.
Motion made by Mr. Livingston for approval from repair of system pending a
pumping of the system at sale of property and again 6 months after the buyers move in
with reports submitted to the Health Departments and with a signed agreement between
the seller and the purchaser. Seconded by Mr. Raposa.
2
