AGENT COMMENTS
The Agent elaborates on the waiver requests that have been submitted. He states that
there is no area for mitigation, which is the reasoning behind the waiver request for Regulation
25-C-2-A. He explains that the waiver request for Regulation 25-C-4 concerns compensatory
plantings. This is due to the significant amount of naturally vegetated areas remaining on the site
based on the proposed work. The Agent clarifies that the proposed retaining wall will be more
than 150 feet from the Limit of Moderate Wave Action(LiMWA) according to the FEMA FIRM
maps. Finally, the Agent recommends that the Commission explain the provisions of Regulation
25-C-7-C (Setbacks) to the applicant and clarify why a waiver is necessary from this provision.
Mr. Colombo acknowledges the difficulty of abiding by Regulation 25-C-7-C but due to
the sensitivity of the area a waiver request should be submitted. Further discussion ensued
regarding fill in the flood zone.
PUBLIC COMMENTS
There are no public comments.
Mr. Colombo reviewed the concerns of the commission and information they would like to
see provided.
