JUNE 12, 2024 <br /> MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> Mr. Reidy read the Conservation Department comments dated June 6, 2024 into the record; <br /> Resource Areas:Land Subject to Coastal Storm Flowage (LSCSF), NOI application for raze and <br /> replace of existing dwelling with installation of IA septic system,pervious parking area,pervious <br /> paver patio, drywells, native rain garden, tree planting, and relocation of shed. NOI application <br /> was approved unanimously at the May 91h hearing date. " <br /> Mr. Reidy read the Board of Health comments dated June 11, 2024 into the record; "Property is <br /> in Zone II 6-11-24 Code Compliance Officer conducted a walk through bedroom count current <br /> house has 3 bedrooms. Septic Plan is designed for 3 bedroom with I/A system. " <br /> Mr. Bonvie asked Mr. Rivera what year storm does the overflow pipe comply for roof drainage, <br /> and does it comply with NOA or DEP Standards. Mr. Rivera stated that a 50, and 100 year storm <br /> will overflow. <br /> Mr. Bonvie at what point does it stop over flow? If the drainage isn't adequate at all for a 1-year <br /> storm why do you claim that you have retention on the site? Mr. Rivera said that he is proposing <br /> retention and drainage system for the roof runoff for a 10-year storm. Mr. Bonvie believes the <br /> system should be designed higher than a 10-year storm. <br /> Mr. Goldstein asked about the cantilever included in the lot coverage. Attorney Kirrane said that <br /> cantilever is always included in the lot coverage which is at 22% and under the 25% requirement. <br /> There were no comments from the audience or Board. <br /> Mr. Bonvie asked for a motion to close the public hearing. Mr. Reidy, so moved. Mr. Furbush <br /> second. All were in favor. <br /> Mr. Reidy made a motion that the Board issue a Special Permit to Owner, Joyce A. Marsters, <br /> Trustee of the Greenwood Trust under §174-17.1, §174-33, and §174-17 of the Zoning Bylaws to <br /> raze and replace a pre-existing, non-confonning single-family dwelling with a new single-family <br /> structure on property located in an R-3 Zoning District,and the Popponesset Overlay District,Map <br /> 117, Parcel 323, Mashpee, MA with the following conditions; <br /> l. The Board has determined that the applicant meets all the conditions of a Special Permit <br /> under Mass General Law 40A Section 9. <br /> 2.
