The Board finds under §174-17.1 and §174-33 that the proposed project is not substantially <br /> more detrimental than the pre-existing, nonconforming structure or use to either the Town <br /> or the neighborhood,that there is sufficient park-ing, and there are no new non-conformities <br /> being created. <br /> Mr. Furbush, second, yes <br /> Mr. Blaisdell, yes, <br /> Mr. Goldstein, yes, <br /> Ms. Sangeleer, yes, <br /> Mr. Bonvie, yes. <br /> All were in favor to issue a Special Permit. <br /> 61 Shoestrinu Bay Road: Owner, 61 Shoestring Bay Road,LLC requests a Variance under§174- <br /> 31 fn. 1, and §174-33 (Setback 50 ft. from the nearest wetland resource area) to construct a new <br /> single family dwelling on the vacant lot located in an R-3 Zoning District, Map 84, Parcel 35, <br /> Mashpee, MA. <br /> Attorney Christopher Kirrane represented the applicant for 61 Shoestring Bay Road. This lot is <br /> located in the Willowbend Development, and is part of an approved plan back in the late 1990's. <br /> This lot abuts a coastal bank that would require a Variance setback of 50 ft. from the wetland <br /> resource area. The site has a significant slope from the front to the rear of the property, and could <br /> be considered a topographical hardship. There are no other variance requests,it's a vacant lot, and <br /> was approved by the Conservation Commission. <br /> Chairman Bonvie addressed the Board members and they all agreed that a Variance application <br /> for this site is warranted. <br /> Mr. Reidy read the Board of Health comments into the record; "Property is on Private <br /> Sewer. " <br /> Mr. Reidy read the Conservation Department Comments dated June 6, 2024 into the record; <br /> "Resource Areas: Salt Marsh, Coastal Bank, and Land Subject to Coastal Storm Flowage <br /> (LSCSF) NOI application for construction of a single family dwelling with pool, patio, <br /> retaining wall, garage with driveway, associated landscaping, hardscaping, mitigation <br /> plantings, and invasive control. NOI was approved at the March 21st hearing date with <br /> conditions for weekly reports of retaining wall construction, bi-weekly staff agent inspection, <br /> pool drawdown by pump truck only, and a three (3)year mitigation and monitoring contract <br /> with a certified professional with a vote of 3:1." <br /> There were no comments from the audience. <br /> Mr. Furbush asked the lot percentage.
