JUNE 12, 2024 <br /> MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> 4. Conditioned on all Town Department comments read into the record including but not <br /> limited to the Board of Health. Conservation Department and DPW comments. <br /> 5. Conditioned that a revised plan be submitted to the Building Department depicting removal <br /> of the rock wall. <br /> 6. Conditioned that the applicant seek and obtain the Town Planner's review in reference to <br /> the Tree Bylaw Chapter 175 of the Town Bylaws prior to the application of a building <br /> permit. <br /> 7. The Board finds under §174-17.1 and §174-33 that the proposed project is not substantially <br /> more detrimental than the pre-existing, nonconforming structure or use to either the Town <br /> or the neighborhood,that there is sufficient parking, and there are no new non-confoimities <br /> being created. <br /> Ms. Sangeleer, second, yes <br /> Mr. Blaisdell, yes, <br /> Mr. Furbush, yes, <br /> Mr. Goldstein, yes, <br /> Mr. Bonvie, yes. <br /> All were in favor to issue a Special Permit <br /> NEW HEARINGS <br /> 3 Elliot Road: Owner, Schooner's Weigh, LLC,requests a Written Finding under§174-17 of the <br /> Zoning Bylaws to allow for a 196.56 sq. ft. addition to the front of the home and replacement of <br /> the existing deck to the rear of the home with a new 16 ft. x 16 ft. (256 sq. ft.) deck of a pre- <br /> existing, non-conforming dwelling, on property located in an R-3 Zoning District, and the <br /> Popponesset Overlay District, Map 117, Parcel 131, Mashpee, MA. <br /> Sitting on this hearing are the four regular Board members and Associate Member, George <br /> Ganzenmuller. <br /> Attorney Christopher Kirrane representing the owner of the property located at 3 Elliot Road.Also <br /> present was Raul Rivera with Cape & Island Engineering. This project is a request for a Written <br /> Finding for two additions, one is a rear deck, and a front covered deck. This property is located in <br /> the Popponesset Overlay District which has minimum dimensional requirements of 6,000 sq. ft. <br /> of lot area, 60 ft. of frontage, a front setback of 25 ft.,rear and side setbacks are 15%, lot coverage <br /> requirement is 25%, and 50 ft. from the wetland resource area. This lot is wholly within coastal <br /> storm flowage, and for lots that are 10,000 sq. ft. or over, there is 0 sq. ft. The lot coverage is <br /> 100%,and the setback to wetlands is zero. There is a non-conforming front setback of 21.5 ft. from <br /> Shore Drive. This property fronts both Elliot Road and Shore Drive. Both proposed additions <br /> comply with current dimensional requirements, and will be within the 25 ft. from Elliot Rd for the <br /> front, and will be within 15 ft. from both sides, and the deck will be 15 ft. from the property line <br /> of the rear and side. <br /> 3 <br />
