CHARTER REVIEW COMMITTEE MINUTES Monday, March 4, 2024* S <br /> There was further discussion regarding addressing the Assistant Town Manager in the Charter, <br /> with similar definitions and adding a provision automatically delegating the Town Manager's <br /> authority to that person. The Assistant Town Manager is in the Town Bylaws so there is no need <br /> to add it to the Charter. <br /> Section 4-2 Powers and Duties <br /> Part b should better define who a Town Officer is, the Committee will need to work on the <br /> language for this section and refer back to legal counsel's definition: <br /> The Term "Town Officer" as defined in Section 1-7 of the Charter has historically been <br /> construed to include all elected and appointed members of Town boards, commissions, <br /> committees established/authorized by statute Charter, or Bylaw; elected individual office <br /> holders (such as Town Clerk); and appointed department heads (as "departments" are <br /> established within the Town's administrative organizational structure from time to time). <br /> Assistant department heads would only fall within the definition of Town Officer while serving <br /> or acting in the capacity as depart head due to the absence, disability, or other inability of the <br /> duly appointed department head to act on the Town's behalf (otherwise, an "assistant" <br /> department head would not have charge of his/ her office or department). <br /> Under 4-2 (g) <br /> Don Myers had some suggested edits "To have full jurisdiction over the rental and use of all town <br /> facilities and property except property under the control of the School Committee, the Board of <br /> Library Trustees, or the Conservation Commission.
