MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> JULY 10, 2024 <br /> Mr. Ganzenmuller read the Conservation Comments dated July 8, 2024 into the record"Resource <br /> Areas:Land Subject to Coastal Storm Flowage (LSCSF), buffer zone to Coastal Dune, and buffer <br /> zone to Coastal Beach. Administrative Approval was issued due to construction of roof over <br /> existing deck will require no new footings, replacement of existing deck on existing footings with <br /> no expansion, relocation of front door, and reduction in width of side deck access steps. " <br /> Mr. Ganzemuller read the Board of Health comments dated July 8, 2024 into the record. "House <br /> is in Zone II, the floor plans shows 3 bedrooms. If they are removing a bedroom from 4 to 3 the 41h <br /> bedroom cannot be put back in in the future because it is in a Zone II and only 10,000 Sq. Ft. of <br /> property. Otherwise no Comment." <br /> There were no comments from the Board or audience. <br /> Chairman Bonvie asked for a motion to close the public hearing. Mr. Furbush made a motion to <br /> close the public hearing. Ms. Sangeleer second. All were in favor. <br /> Chairman Bonvie asked for a motion in reference to the application. <br /> Discussion: Mr. Goldstein asked for clarification regarding the Board of Health comment. Mr. <br /> Rivera stated that the bedroom count will remain the same. <br /> The Board of Health is reminding the applicant if they remove the fourth bedroom to a three <br /> bedroom,the home must remain three bedrooms,they cannot return to four bedrooms. The home <br /> must remain three bedrooms. <br /> Mr. Goldstein make a motion that the Board issue a Written Finding to Owner, Mary Jane Colton, <br /> Trustee of the 93 Bluff Avenue Realty Trust under §174-17 and §174-33 of the Zoning Bylaws to <br /> allow for construction of a roof over the existing deck, reconfigure the access stairs to deck, and <br /> add a new front entry way to a pre-existing,nonconforming dwelling on property located in an R3 <br /> Zoning District and the Popponesset Overlay District, at 93 Bluff Avenue, Map 118 Parcel 57, <br /> Mashpee, MA with the following conditions: <br /> 1. The Board has determined that the applicant meets all the conditions of a Written Finding <br /> under Mass General Law 40A Section 6. <br /> 2. Site Plan— Prepared for Mary Jane Colton, Trustee, Project: 93 Bluff Avenue, Mashpee. <br /> Sheet No. 1 of 1, Date: October 3, 2022.
