MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> JULY 10, 2024 <br /> 7. Conditioned on recommendations submitted by the Plan Review Committee: <br /> • Conditioned that there are no storage containers pods or alike onsite. <br /> • Conditioned that the 30 x 35 ft. track pad be the access point to the site and <br /> will be adequately maintained in perpetuity. <br /> • Conditioned that the applicant consider rodent control around the perimeter <br /> of the property to protect the abutting property owners. <br /> • Conditioned that a locked gate be installed with a Knox Box for Fire <br /> Department access. <br /> 8. Any changes to the plan will require the applicant to return to this Board. <br /> 9. The Board finds that the proposed contractors yard is consistent with applicable State and <br /> Town regulations, statues, bylaws and plans including but not limited to §174-24 (C) (2), <br /> and §174-25 G (13). <br /> 10. Storm water O&M Plan/Manual shall be recorded concurrently with the Special Permit <br /> recording. <br /> 11. Ed Pesce Engineering shall sign off on the as-built depicting the fact that all work is in <br /> compliance of the approved plans. Said signoff shall be completed prior to the storage of <br /> any materials and onsite equipment. <br /> Ms. Sangeleer second, yes. <br /> Mr. Blaisdell, yes, <br /> Mr. Goldstein, yes, <br /> Mr. Furbush, yes, <br /> Mr. Bonvie, yes. <br /> All were in favor to issue a Special Permit. <br /> 93 Bluff Avenue: Owner,Mary Jane Colton,Trustee of the 93 Bluff Avenue Realty Trust requests <br /> a Written Finding under §174-17 and §174-33 of the Zoning Bylaws to allow for construction of <br /> a roof over the existing deck, reconfigure the access stairs to deck, and add a new front entry way <br /> to a pre-existing, nonconforming dwelling on property located in an R3 Zoning District and the <br /> Popponesset Overlay District, Map 118 Parcel 57, Mashpee, MA. <br /> Sitting on this hearing are the five regular Board members. <br /> Attorney Christopher Kirrane represented the homeowners requesting a Written Finding under <br /> 174-17 for three alterations to the existing structure. The site plan provided by Cape & Islands <br /> Engineering highlighted the area depicting an overhang over an existing deck, reconfiguring the <br /> stairs, and adding a front entry way. The lot is located in the Popponesset Overlay District, and <br /> is totally in the flood zone which makes the lot non-conforming at 100% lot coverage, and <br /> setbacks to wetlands is zero. There are no new non-conformities being created. The actual <br /> structure coverage is decreasing. The lot coverage is 19.6% and is not increasing. The stairs are <br /> not encroaching on any setbacks. <br /> 6 <br />
