5 <br /> Select Board <br /> Minutes <br /> Jul, 2&2024 <br /> APPOINTMENTS & HEARINGS <br /> Discussion of Conservation R tilation 25: Representatives of the,Pollonesset Island Association Poppon <br /> Working Grou Peninsula Council: (continued) <br /> It was disclosed the representatives of Popponesset as presented have hired legal counsel to review the analysis <br /> on Regulation 25. The Select Board was requested to partner with the community and collaborate, a process that <br /> is critical in making this regulation work. <br /> Selectman Weeden had a priority of concerns in preserving assets and rights to develop offering a strong voice in <br /> the preservation and protection of water bodies which have become well-known as eutrophic. Development has <br /> run its course for many years, and the waterways cannot take on more development. The Town at present is <br /> trying to address climate impacts and algae blooms to achieve clean water. <br /> Mr. Malloy indicated that Popponesset is a homeowners community comprised of 580 homes. Currently,the <br /> association is proposing a resilient strategy,working on sewer and lines the Town cannot afford to undertake. <br /> Everyone is for clean water. There are water issues on the beach and in the bay however there are homeowner <br /> property rights. If the regulation does not grant the homeowner the ability to modify,they may not be willing to <br /> install an I/A system. Mr. Malloy further stated that we are all in this together,we are not developers,just <br /> homeowners trying to do what is best. <br /> Chris Conti, a resident of 45 Popponesset Island Road indicated he recently moved to Mashpee. Having <br /> experience in this matter Mr. Conti recommended that discussions ensue to reach shared goals and a shared <br /> momentum of accelerating those goals. The volunteer work of the Conservation Commission was <br /> acknowledged. In support of the workshop process Mr. Conti indicated that it is important to ensure the scope of <br /> the change which in this case is of large scale and complex change to bring forth goals with clarity. The groups <br /> before the Select Board are seeking to engage the entire community in a common goal with respect for the <br /> property rights of all residents to ensure the vitality of the Town of Mashpee continues to thrive. <br /> With respect to process and procedures hearings duly advertised are scheduled for public comment on proposed <br /> revisions. There is no requirement for engagement with private or exclusive authorities. <br /> Copies of the emails,the Conservation Chair received from John Malloy regarding draft Regulation 25, and dated <br /> collectively on July 29, 2024 were distributed to the Select Board members. The original document is contained <br /> in the Select Board's informational packet retained in the Town Manager/Select Board Office. <br /> Discussion followed with the timeline, and possibly holding a public hearing for comment. However, there is <br /> concern with respect to setting precedent regarding procedures in place that should be adhered to. <br /> It was agreed the Town Manager would confer with Town Counsel to determine the next step in this process. <br />
