MEETING MINUTES <br /> MASHPEE ZONING BOARD OF APPEALS <br /> WEDNESDAY,JULY 24, 2024 <br /> 4. Conditioned on all Town Department comments read into the record including but not <br /> limited to the Conservation Department and Board of Health. <br /> 5. Any changes to the plan will require the applicant to return to this Board. <br /> 6. The Board finds that the proposed project under §174-17 and §174-33 is not substantially <br /> more detrimental than the pre-existing, nonconforming structure or use to either the Town <br /> or the neighborhood. <br /> Ms. Sangeleer, second, yes, <br /> Mr. Goldstein, yes, <br /> Mr. Reidy, yes, <br /> Mr. Furbush, yes, <br /> Mr. Bonvie, yes. <br /> All were in favor to issue a Written Finding. <br /> 32 Cordwood Road: Owner, Joseph M. Donovan requests a Special Permit under §174-17.1 of <br /> the Zoning Bylaws to raze and replace an existing single-family residential structure with a new <br /> single-family residential structure on property located in an R-3 and the Popponesset Overlay <br /> District, Map 118, Parcel 1, Mashpee, MA. <br /> Sitting on this hearing are the four regular Board members and Mr. Caggiano. <br /> Attorney Christopher Kirrane representing the homeowner at 32 Cordwood Road located in the <br /> Popponesset Overlay District which requires 6,000 sq. ft. of lot area, 60 ft.of frontage,25 ft.front <br /> yard setback, and 15 ft.rear and side yard setbacks. The homeowner is seeking a Special Permit <br /> under §174-17.1 to raze and replace the single-family structure. <br /> This lot is 7,181 sq. ft.lot. There are no flood zone impacts on this lot, and is conforming. There <br /> is over 60 ft. of frontage along Cordwood Road and the Way to the north. There are two front yard <br /> setbacks and two rear yard setbacks. The lot size and frontage are conforming. There are three <br /> nonconformities. It is currently 11 ft.from the front yard setback on Way Rd, 14 ft. from the rear <br /> yard setback of Way Rd,and the lot coverage is nonconforming at 26.4%. The lot coverage of the <br /> new home will be reduced to 24.5%, and will become a conforming lot. The rear yard setback is <br /> currently 14 ft., and will become conforming at 15 ft. The setback from the Way Rd. will be <br /> improved from 11 ft.to 15 ft. Thereby eliminating two nonconformities, and improving the third <br /> nonconformity. There will be a new I/A septic system installed, it will be building code compliant <br /> with dry wells and there is no increase in the bedroom count. There are no new nonconformities <br /> being created, and not intensifying any existing nonconformities. <br /> Mr. Reidy read the Board of Health comments dated July 23, 2024 into the record; "No comment <br /> to remain 3 bedroom with the addition ofI/A septic system per Mashpee 1000 foot11A regulations. <br /> 8 <br />
