MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A WRITTEN FINDING <br /> Owners, Joseph T. Marino and Kathie A. Marino <br /> 14 Ashumet Avenue, (Map 49 Parcel 104) <br /> Mashpee, MA 02649 <br /> FINDING-2024-03 <br /> GENERAL FINDINGS <br /> The Board read the Board of Health comments dated February 8, 2024 into the record; "Room <br /> over garage would be 4`" bedroom. Septic is designed for four bedrooms, house to remain four <br /> bedrooms. "The Building Department comments dated February 6,2024; "The proposed changes <br /> to the existing floor plan provide a continuous and unobstructed path of travel to the primary <br /> egress and is acceptable. " <br /> The Board read the DPW Director's comments dated January 8, 2024 into the record: "Ashumet <br /> Avenue is a Town road. While no modifications to the existing paved driveway are proposed, <br /> currently storm water runoff from the property flows to the road. At a minimum, I request that any <br /> approval be conditioned upon installation of gutters, downspouts, and drywells on the garage to <br /> address the roof runoff. " <br /> The Board read the Town Planner's comments dated January 5, 2024 into the record, "The <br /> Planning Department suggests that the proposed continuance, extension or alterations proposed <br /> would not be substantially more detrimental to the neighborhood than existed previously and that <br /> the Board can grant a written finding. If any bedroom is to be added above the garage then the <br /> septic system must be upgraded at the appropriate time. " <br /> The subject property located at 14 Ashumet Avenue has 11,250 square feet of land. The lot is pre- <br /> existing, non-conforming as it requires 80,000 sq. ft. in the R-5 Zoning District. The existing lot <br /> coverage is 19.0%, and the requested lot coverage is 19.7%which is under the 20%requirement. <br /> There were no abutters present. <br /> WRITTEN FINDING CRITERIA <br /> ARTICLE V -Nonconforming Buildings and Uses: <br /> §174-17. Continuance; Extensions; Alterations - Lawfully created structures or uses may be <br /> continued, although not conforming with the provisions of this chapter. Non-conforming single- <br /> or two-family dwelling structures may be changed, extended or altered if such change, extension <br /> or alteration complies with the dimensional requirements applicable to the lot under current <br /> provisions of§174-31 or, for lots which have been developed pursuant to §174-21, complies with <br /> such requirements as were applicable to initial construction of the dwelling under provisions of <br /> §174-21. <br /> 2 <br />
