MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A WRITTEN FINDING <br /> Owners of record: Robert Paquette and Marcia Paquette <br /> 84 Uncle Edwards Road, Map 117, Parcel 209 <br /> Mashpee, MA 02649 <br /> FINDING-2024-05 <br /> GENERAL FINDINGS <br /> The Board of Health comments dated January 22, 2024 were read into the record; "No increase <br /> inflow to remain (3) three bedroom. Don't put deck footings on septic pipe. " <br /> The Conservation Department comments dated January 23, 2024 were read into the record. No <br /> other comments. "No wetlands jurisdiction." <br /> Chairman Bonvie polled the Board for questions/comments. <br /> Mr. Morris asked for the bedroom count with the proposed increase in the basement living space. <br /> Mr. Cook stated that there will be one bedroom on the first floor, and two bedrooms in the <br /> basement with egress windows. Mr. Morris stated the building code renovations are over 100%of <br /> the value of the house, and will require to bring the energy rating up to current HERS standards <br /> for the entire house, and is very attainable. <br /> The Board confirmed that a dry well will be installed under the location of the new addition to <br /> capture any water runoff. There are no other dry wells being installed. Mr. Cook stated that BSS <br /> Design only added one dry well on the site plan. <br /> The subject property located at 84 Uncle Edwards Road contains a total of 6,500 sq. ft. of land. <br /> For purposes of calculating minimum lot size under §174-31 n. 18, the existing lot area is 1,279 <br /> sq. ft., at 19.67%, and the proposed is 1,343 sq. ft., at 20.66%. The subject lot is located within the <br /> Popponesset Overlay District. The minimum dimensional requirements in the Popponesset <br /> Overlay District are as follows: <br /> Minimum Lot Size—6,000 sq. ft. <br /> Minimum Frontage—60 ft. <br /> Minimum Front Yard Setback—25 ft. <br /> Minimum Rear and Side Yard Setbacks— 15 ft. <br /> Maximum lot coverage—25% <br /> There were no abutters present. <br /> WRITTEN FINDING CRITERIA <br /> ARTICLE V -Nonconforming Buildings and Uses: <br /> §174-17. Continuance; Extensions; Alterations - Lawfully created structures or uses may be <br /> continued, although not conforming with the provisions of this chapter. <br /> 2 <br />
