Jackmauh and Anne M. Wood, <br /> Co-Trustees of the RJAW Family Revocable Trust request a Written Finding under §174-17 and <br /> §174-33 to allow for a 460 sq. ft. addition, and a deck to a pre-existing, nonconforming structure <br /> on property located in an R-3 Zoning District, at 231 Monomoscoy Road, Map 114, Parcel 98, <br /> Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. <br /> Notice was given by publication in The Mashpee Enterprise,a newspaper of general circulation in <br /> the Town of Mashpee, on February 16, 2024 and February 23, 2024 a copy of which is attached <br /> hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br /> Massachusetts General Laws Chapter 40A §6 and the Town of Mashpee Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on Wednesday, March 13, <br /> 2024 at which time the following members of the Board of Appeals were present and acting <br /> throughout; Chairman, Ronald Bonvie, Board Members, Sharon Sangeleer, William A. Blaisdell, <br /> Jonathan Furbush, and Scott Goldstein. Also present was David Morris,Building Commissioner. <br /> Attorney Christopher Kirrane represented the applicants seeking a Written Finding for approval of <br /> an addition to a pre-existing non-conforming structure located in the R-3 Zoning District. The lot <br /> is non-conforming at 10,700 sq. ft.,and is partially in the flood zone. The existing structure is non- <br /> conforming in three ways. There's two front yard setbacks that are non-conforming, one is 25.3 ft. <br /> from Monomoscoy Road, and the other front yard setback is 26.5 ft. from Childs Road where 40 <br /> ft. is required, and the existing structure is not setback 50 ft. from the (LSTCSF) Land Subject to <br /> Coastal Storm Flowage. <br /> The applicants are proposing a modest addition in the rear of the structure and it is in an already <br /> disturbed lawn area. The addition will be compliant, and there are no new non-conforming <br /> conditions being created, and it is not intensifying any existing non-conformities. <br /> 1 <br />
