MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A WRITTEN FINDING <br /> Richard T. Jackmauh and Anne M. Wood Trustees <br /> Of the RJAW Family Revocable Trust <br /> 231 Monomoscoy Road, Map 114, Parcel 98 <br /> Mashpee, MA 02649 <br /> FINDING-2024-10 <br /> The current lot coverage is 13%, and with the addition it will be 17.5% which is under the 20% <br /> requirement. The Conservation Commission approved the project. This redevelopment is <br /> consistent with other redevelopments in the neighborhood. <br /> GENERAL FINDINGS <br /> The Board of Health comments dated February 27,2024 were read into the record; "to remain <br /> 2 bedroom. Variance from septic tank expired 12-31-23. " <br /> The Assistant Conservation Agent comments dated March 8, 2024 were read into the record; <br /> "RDA application received a Negative Determination with condition for erosion control around <br /> spoils pile. Addition in rear of house will be flood compliant and will was determined to have no <br /> adverse impact on wetlands. " <br /> The comments submitted by the Town Planner dated March 13, 2024 were read into the record: <br /> "The Planning Department suggests that the proposed continuance, extension or alterations <br /> proposed would not be substantially more detrimental to the neighborhood than existed previously <br /> and that the Board can grant a written finding. Please confirm that the house is not to exceed 2 <br /> BRs. I understand that there is a deed restriction preventing anything beyond 2 BRs. " <br /> There were no comments from the Building Commissioner. <br /> The subject property located at 232 Monomoscoy has 10,700 square feet of land and is non- <br /> conforming in the R-3 Zoning District. <br /> There were no abutters present. <br /> WRITTEN FINDING CRITERIA <br /> ARTICLE V -Nonconforming Buildings and Uses: <br /> §174-17. Continuance; Extensions; Alterations - Lawfully created structures or uses may be <br /> continued, although not conforming with the provisions of this chapter.Non-conforming single- <br /> or two-family dwelling structures may be changed, extended or altered if such change, extension <br /> or alteration complies with the dimensional requirements applicable to the lot under current <br /> provisions of§174-31 or,for lots which have been developed pursuant to §174-21,complies with <br /> such requirements as were applicable to initial construction of the dwelling under provisions of <br /> §174-21. <br /> 2 <br />
