MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> AUGUST 14, 2024 <br /> 3 Pinecrest Avenue: Petitioner, Michael S. Cannata requests a Written Finding under §174-17 of <br /> the Zoning Bylaws to allow for construction of a three-season room above a pre-existing, <br /> nonconforming attached garage on property located in an R-5 Zoning District,Map 49,Parcel 168, <br /> Mashpee, MA. (Owner of Record: Lorraine E. Barry, Trustee of the K& M Realty Trust). <br /> Sitting on this hearing are the four regular Board members and Associate Member, Mr. <br /> Ganzenmuller. <br /> Mr. Mike Cannata, Building and Remodeling represented the homeowners for their request to add <br /> a three-season room above an existing garage. The garage has a flat rubber roof and has been <br /> problematic for several years, and the homeowners would like to repair it, but would like to add <br /> some living space. There will be no heat or potable water. There is no work encroaching on any <br /> setbacks. The garage was built in 1988 and was given a Variance. <br /> Mr.Reidy read the Board of Health comments dated August 9,2024 into the record;"No Comment, <br /> to remain 3 bedroom. " The Conservation Department comments dated August 12, 2024 into the <br /> record; `Not within wetlands jurisdiction." <br /> The Board had a discussion whether the three-season room will be hearted or not. They could <br /> impose a condition that it remains unheated if necessary. <br /> Mr. Goldstein asked if the slider is the means of egress. Mr. Cannata stated that the slider will <br /> remain because that is the thermal break. <br /> There were no more Board questions. <br /> Chairman Bonvie confirmed that there are no new nonconformities being created. <br /> Mr. Furbush made a motion to close the public hearing. Mr. Ganzenmuller, second. All were in <br /> favor to close the public hearing. <br /> Chairman Bonvie asked for a motion on the public hearing. <br /> Mr. Reidy made a motion that the Board issue a Written Finding under §174-17 to Petitioner, <br /> Michael S. Cannata and Owners of Record; Lorraine E. Barry, Trustee of the K&M Realty Trust <br /> with the following conditions: <br /> 1. The Board has determined that the applicant meets all the conditions of a Written Finding <br /> under Mass General Law 40A Section 6. <br /> 2. As-built Plot Plan— Lot 104 Pinecrest, Prepared by Land Use Technology, Inc., Job No.: <br /> 81-1385, Date: 11/26/88, Client: Barry, Scale: 1" = 40'.
