MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> AUGUST 14, 2024 <br /> The first is the lot size which consists of 23,845 sq. ft., second, is the 50 ft. setback to wetlands. <br /> There is a shed on the property that is greater than 120 sq. ft. and is only 7.7 ft. from the property <br /> line and is being removed and will eliminate that nonconformity. There are no flood zone issues. <br /> The actual lot coverage is 14.67%. The new structure and garage will meet all setback <br /> requirements. The increase in lot coverage will be 19.97%that is under the current requirements. <br /> Attorney Kirrane mentioned the improvements that will be made to the property. The house will <br /> be building code compliant, there will be a new I/A septic system, drywells, and has been approved <br /> by the Conservation Commission. There will be no new nonconformities created. Other than the <br /> 50 ft. setback to wetlands, the new construction will comply with current day zoning requirements. <br /> Mr. Reidy read the Conservation Department comments dated August 12, 2024 into the record; <br /> Resource Areas: Buffer zone to Salt Marsh, buffer zone to Bordering Vegetated Wetlands (BVW), <br /> buffer zone to Coastal Bank, & Area of Critical Ecological Concern (ACEC). Notice of Intent <br /> (NOI)permit application was approved with a 4-1 vote. Raze & replace of existing structure with <br /> additions and rebuild of existing dock was approved due to increased mitigation, reduction in <br /> access path width,planting offive native trees, and updating the dock/pier/float system will create <br /> better conditions for the ACEC. <br /> Mr. Goldstein read the Board of Health comments dated August 14, 2024 into the record; "Septic <br /> Design is for 4 bedroom." <br /> Mr. Blaisdell asked Attorney Kirrane if he wanted to withdraw Section 174-17 he did not apply <br /> for this section. <br /> Chairman Bonvie confirmed that all nonconformities were removed except for the 50 ft. setback <br /> from wetlands. <br /> Mr. Furbush asked if the existing board walk will be rebuilt, and if Conservation had any issues. <br /> Attorney Kirrane mentioned that there were a couple of meetings with Concom and was approved. <br /> Chairman Bonvie summarized; most of the existing foundation will remain, there will be a new <br /> UA septic system, and removing all nonconformities except the 50 ft. setback to wetlands. <br /> There were no more questions from the Board. There were no comments from the audience. <br /> Mr. Furbush made a motion to close the public hearing. Mr. Blaisdell second. All were in favor. <br /> Attorney Kirrane requested a withdrawal from Section 174-17. <br /> Chairman Bonvie asked for a motion. Mr. Blaisdell, so moved. Mr. Ganzenmuller, second.
