MASHPEE ZONING BOARD OF APPEALS MEETING MINUTES AUGUST 28, 2024 1. The Board has determined that the applicant meets all the conditions of a Written Finding under Mass General Law 40A Section 6. 2. Borselli, Civil No.: 35054, and Gary S. Labrie, No.:40039, Dated: 7/10/24. 3. Additions & Renovation Plans— Conti Residence, 45 Popponesset Island Road, Mashpee, MA. Date: July 16, 2024, A-1: First Floor Plan, A-2: Second Floor Plan, A-3: Exterior Elevations. Prepared by: K. Marshall Works Design. 4. Conditioned on all Town Department comments read into the record including but not limited to the Board of Health and Conservation Department comments. 5. Any changes to the plans will require the applicant to return to this Board. 6. Conditioned that the applicant seek and obtain the Building Department review in reference to the Tree Bylaw Chapter 175 of the Town Bylaws prior to the application of a building permit. 7. The Board finds under §174-17 and §174-33 that the proposed project is not substantially more detrimental than the pre-existing, nonconforming structure or use to either the Town or the neighborhood. Simoneau, Trustee requests a Written Finding under §174-17 and §174-33 of the Zoning Bylaws to allow for construction of a 516 sq. ft. addition/replacement with a new stairway to a pre-existing, nonconforming structure on property located in an R-3 Zoning District, Map 106, Parcel 4-0, Mashpee, MA. Sitting on this hearing are the four regular Board members and Mr. Caggiano. Ms.Jean Bowden,represented LeBlanc Builders,who will be doing the construction to the existing dwelling that involves renovations to the existing decks located in the front and rear,and also some interior work. Also present was John Simoneau, homeowner. 8
