MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> AUGUST 28, 2024 <br /> The Building Commissioner suggested that a Written Finding application under §174-17 and <br /> §174-33 of the Zoning Bylaws was required because the house is pre-existing, nonconforming in <br /> the R-3 Zoning District. The pre-existing lot coverage is 32.8% and will reduce to 31.3%. The pre- <br /> existing nonconforming setback to the wetlands is 23 ft. and 19 ft. to the coastal bank,but will not <br /> affect the area of construction. <br /> Mr. Simoneau described the reconstruction inside the dwelling. There is an existing loft area with <br /> a spiral staircase that will be converted to a bedroom with a code compliant staircase, and will <br /> eliminate a first floor bedroom to accommodate that new room, but it will remain a three bedroom <br /> dwelling. The front deck will be extended slightly to enhance the mechanical room, and the rear <br /> deck will be extended slightly. The non-conformity will remain the same. The front setback will <br /> be a slight improvement from 21.2 ft. to 22.6 ft. <br /> Mr. Reidy read the Board of Health comments dated August 27, 2024 into the record; "To remain <br /> 3 bedroom. House already equipped with I/A septic. <br /> Mr. Reidy read the Conservation Department comments dated August 27, 2024 into the record; <br /> "Resource Area: Buffer to BVW, buffer to coastal bank, &LSCSF. Administrative Approval (AA) <br /> was issued due to the two (2)proposed additions to existing dwelling will be on existing piles and <br /> installation of drywells to control roof runoff with a work limit in place until AA is closed out. " <br /> Mr. Reidy read the Conservation Agent approval letter dated December 14, 2023 into the record. <br /> There were no comments from the Board. <br /> Mr. Morris asked if the building height will increase. Mr. Simoneau said; "yes"it will. Mr. Morris <br /> stated he will have to review the building permit plans. <br /> Chairman Bonvie asked the applicant if he is creating any new non-conformities. Mr. Simoneau <br /> said; "no". <br /> Mr.Furbush made a motion to close the public hearing. Mr. Blaisdell, seconded.All were in favor. <br /> Mr. Reidy made a motion that the Board issue a Written Finding to Owner, John T. Simoneau, <br /> Trustee under §174-17 and §174-33 of the Zoning Bylaws at 16 Taffrail Way with the following <br /> conditions: <br /> l. The Board has determined that the applicant meets all the conditions of a Written Finding <br /> under Mass General Law 40A Section 6. <br /> 2. Proposed Site Plan:Prepared for: John T.
