Conditioned on all Town Department comments read into the record including but not <br /> limited to the Board of Health and Conservation Department comments. <br /> 5. The Board finds under §174-17 and §174-33 that the proposed project is not substantially <br /> more detrimental than the pre-existing, nonconforming structure or use to either the Town <br /> or the neighborhood. <br /> Ms. Sangeleer, second, yes, <br /> Mr. Caggiano, yes, <br /> Mr. Milbury, yes, <br /> Mr. Reidy, yes, <br /> Mr. Bonvie, yes. <br /> All were in favor to issue a Written Finding. <br /> 75 Popponesset Island Road: Owners, Matthew David Hudson and Carol Marie Hudson request <br /> a Written Finding under §174-17 and §174-33 of the Zoning Bylaws to allow for construction of <br /> a stairway to access an existing deck, and add a screened in deck with a screened in porch below <br /> on property located in an R-3 Zoning District, Map 106, Parcel 8, Mashpee, MA. <br /> Attorney Kirrane represented the homeowners requesting a Written Finding under §174-17 and <br /> §174-33 to alter a pre-existing, nonconforming single family residence. Also present was Mark <br /> Dibb with Cape and Islands Engineering. <br /> The proposal includes a stairway access to a first story deck, and a screened in porch on the rear <br /> of the house with a screened in deck above. The property is located in the R-3 Zoning District. <br /> This lot is located in the R-3 Zoning District which requires a minimum lot size of 40,000 sq. ft. a <br /> minimum frontage of 150 ft., a 40 ft. front yard setback, and 15 ft. side and rear yard setback, 20% <br /> lot coverage, and a 50 ft. setback from wetlands. <br /> 6 <br />
