■ Bottom of the boat should be at least 2.5 feet above the substrate over the marine habitat. ■ Based on the proposed project, following the recommended 2.5ft separation is not feasible. The maximum height would be 18 inches. o Shellfish Habitat Displacement ■ Project will displace shellfish habitat but under Shellfish Constable,no mitigation fee is warranted. ■ Further discussion ensued. o Boat Size: ■ Current boat size: 14ft, 12in draft ■ Proposed boat size: approximately 25ft, 14in draft ■ Due to concerns about the negative impact of a larger boat, it is asked if mooring has been considered. There has been no discussion on mooring with the applicant. o Float stops: ■ Yes, 12 inches. PUBLIC COMMENTS -None AGENT COMMENTS • Public access provided under the fixed pier • The existing float is 9'x 20' (180 sq ft). Proposed is 8'x24'(190 sq ft) • Proposed decking on pier extension to allow for 50% sunlight penetration • Float stops proposed to maintain 1.2 ft of separation from bottom sediments • Concerns remain regarding propeller dredging due to the shallowness of this area. • DMF recommends that any piles must be removed entirely and not cut off at the base where it meets the sediment. • Agent recommends the following conditions if approved: 1. Require through flow decking along the entire stretch of the fixed pier(existing and proposed) 2. Restricting engine draft to no more significant than the existing float requires float stops. 3. Provide information on the engine draft of vessel(s) to be moored at float with a restriction on a draft of no more than 12 inches. 4. Provide proof of the status of the existing Ch. 91 license with a copy of the existing recorded license to the Conservation Dept. *Additional discussion ensued, resulting in the applicant's request for a continuance. 6
