MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> OCTOBER 9, 2024 <br /> Chairman Bonvie mentioned that there is very little parking on Monomoscoy Road and he is not <br /> sure that parking is available. He would like more information from the engineer that the drywells <br /> will capture a 25-year storm event. <br /> The Board had a discussion regarding the stairway on the outside of the proposed building. They <br /> believe that would be up to the applicant and the concerned neighbor. Chairman Bonvie said that <br /> the Board has discussed options with applicants in the past. <br /> Mr. Reilly mentioned there is a set of stairs on the inside as depicted on the building drawings. <br /> Chairman Bonvie is more concerned with the water runoff. Mr. Reilly said that there will be 2" <br /> crushed stone installed on the surface. <br /> Mr. Morris said he has several concerns with this proposal. The lot size is 40 ft. by 100 ft. The lot <br /> at 17 Childs Road is owned by his partner, and is rented. The building plans as presented depict <br /> the primary use for a garage with an apartment which is not allowed. The applicants intend to store <br /> their boat in the garage, and rent the apartment above. <br /> Mr. Reilly said that the primary use would be a house with a garage underneath. <br /> Mr. Furbush agrees that the use is not allowed because the house needs to be the primary use, not <br /> the garage. <br /> Mr. Morris is concerned with the zoning aspect of the proposal. He knows that Mr. Reilly's partner <br /> is renting the house next door at 17 Childs Road, and that the proposed garage and apartment is <br /> not allowed unless it is owner occupied as in the zoning bylaw under Section 174-45.4. <br /> Mr. Morris also stated that the lavatory in the garage needs to be eliminated because the structure <br /> is in the flood zone, and he wants confirmation of the building height. <br /> Ms. Silva addressed the Board and stated that she owns the property next door, and is not married <br /> to Mr. Reilly. The lots cannot be combined. She also stated that relocating the outdoor stairs to the <br /> other side of the proposed building will impose on the neighbors at 17 Childs Road, and the <br /> neighbors on Monomoscoy Road. <br /> Mr. Jackmauh addressed the Board and has concerns with the parking and construction vehicles <br /> as mentioned in his letter that the Board read into the record. <br /> Mary Cassanelli's addressed the Board and asked if an outside stairway is allowed if there is <br /> already a stairway inside the house. Mr. Morris said that there needs to be two sets of egress. <br /> Mr. Dehelean, Associate Board Member asked Mr. Jackmauh what the difference of concerns <br /> would be compared to the applicant in terms of the presence of construction vehicles. Mr. <br /> Jackmauh said that he has a larger driveway, and his addition is not as significant. <br /> 7 <br />
