MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> OCTOBER 9, 2024 <br /> The new project will not be creating any new nonconformities. The new dwelling will be <br /> eliminating the nonconformity of the front setback from 35.4 ft. to 44.3 ft. The northwest side will <br /> be improving from 11.1 ft. to 11.2 ft., the southeast side will be improving from 9.8 ft. to 9.9 ft., <br /> and the rear yard setback will improve from 13.6 ft. to 13.7 ft. The lot coverage is increasing <br /> slightly from 770 sq. ft. to 799 sq. ft., and will be 19.98%under the 20%requirement. The 799 sq. <br /> ft. includes 69 sq. ft. egress stairs so the structure itself is 730 sq. ft. at 18.25% without including <br /> the stairs. <br /> The current home is connected to a cesspool and will be replaced with a new IA System. There <br /> will be drywells installed and the project was approved by the Conservation Commission. <br /> Mr. Reidy read the Conservation Department comments dated October 2, 2024 into the record. <br /> "Resource Areas: Land Subject to Coastal Storm Flowage (LSCSF). NOI application received <br /> approval with a unanimous vote due to IA septic install and mitigation plantings on a lot were no <br /> natural vegetation currently exist. The following conditions were applied to the approval:" <br /> • Two year mitigation monitoring and maintenance contract with a certified <br /> professional <br /> Mr. Reidy read the Board of Health comments dated October 4, 2024 into the record; "Septic <br /> Designed jor 2 bedroom with I/A Technology, house is only I bedroom. No problems with Health <br /> Department. " <br /> Mr. Reidy read a letter from Mary Cassanelli's, 11 Childs Road, dated October 9, 2024 into the <br /> record regarding her concern with the outside stairs of the proposed structure, and asked if the <br /> stairs could be moved on the opposite side of the dwelling. <br /> Mr. Reidy read a letter from Richard Jackmauh's, 231 Monomoscoy Road dated October 9, 2024 <br /> into the record and his concerns were parking, and construction vehicles during demolition and <br /> building of the structure. The letter included other direct abutters. <br /> Mr. Furbush asked the applicant to address the concerns of the abutters. <br /> Mr. Reilly stated that the lot consists of 4,000 sq. ft., and his contractor could manage the project <br /> to be less impactful during construction. The garage will be 39 ft. long and can store vehicles and <br /> material once the framing is done. There is also parking on Monomoscoy Road. There will be no <br /> dumpster onsite; the debris will be carted away in trucks. His intention is that the project will be <br /> completed by spring. There will be at least two parking spaces, and will have an H-20 septic tank. <br /> Mr. Reilly would consider moving the stairs to the other side of the structure after having a <br /> conversation with his builder. <br /> 6 <br />
