»� Fawn of Mashpee <br /> 16 Great Neck Road North <br /> ^; Mashpee, MA 02649 <br /> MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A WRITTEN FINDING <br /> FINDING-2024-20 <br /> Owners, Fernando Carreiro and Doc.: 1336235 <br /> Eduarda Frias Carreiro Ct£: 214887 <br /> 1 Pontiac Road <br /> Map 125, Parcel 58 <br /> Mashpee, MA 02649 <br /> A Petition was filed on April 9,2024 by Owners,Fernando and Eduarda Frias Carreiro requesting <br /> a Written Finding under §174-17 and §174-33 (Setback from wetlands), of the Zoning Bylaws to <br /> allow for construction of a 9 ft. x 21 ft. plunge pool on property located in the R3 Zoning District, <br /> at 1 Pontiac Road, Map 125, Parcel 58, Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. <br /> Notice was given by publication in The Mashpee Enterprise,a newspaper of general circulation in <br /> the Town of Mashpee, on April 26, 2024 and May 3, 2024 a copy of which is attached hereto and <br /> made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br /> Massachusetts General Laws Chapter 40A §6 and the Town of Mashpee Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on Wednesday,May 22,2024 <br /> at which time the following members of the Board of Appeals were present and acting throughout; <br /> Chairman,Ronald Bonvie,Board Members, Sharon Sangeleer,Jonathan Furbush, Scott Goldstein, <br /> and Associate Member, George Ganzenmuller. <br /> Attorney Christopher Kirrane represented the owners who are seeking a Written Finding for a <br /> plunge pool. This application is before the Board because it is non-conforming to the wetland <br /> setbacks and is partially in the flood zone. The house conforms to all the setback requirements. <br /> The pool will conform to all setback requirements other than the setback to wetlands. The existing <br /> structure meets lot coverage,and will meet the lot coverage with the proposed pool. The reduction <br /> from (LSTCSF) Land Subject To Coastal Storm Flowage lot coverage is under 20% in the R-3 <br /> Zoning District. The lot size is 17,021 sq. ft. However,with the deduction of LSTCSF,the lot size <br /> is 11,080 sq. ft. The existing structure is 1,986 sq. ft. which is 17.9% lot coverage, and with the <br /> proposed pool the lot coverage will be 19.6%. The lot will remain conforming. The project was <br /> approved by the Conservation Commission, and there are no new non-conformities being created. <br /> 1 <br />
