MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A WRITTEN FINDING <br /> Owners, Fernando Carreiro and Eduarda Frias Carreiro <br /> 1 Pontiac Road, Map 125, Parcel 58 <br /> Mashpee, MA 02649 <br /> FINDING-2024-20 <br /> GENERAL FINDINGS <br /> The Board reviewed the site plan and confirmed that the existing structure is in Zone X which is <br /> out of the flood zone. <br /> The Conservation Department comments were read into the record; "The Commission approved <br /> this project at their April 01 2024 public meeting. The proposed pool and patio areas lie just <br /> outside of the 100 year floodplain in areas currently occupied by lawn and a few native trees. No <br /> fill proposed (other than regrading of excavated materials) or significant alteration of existing <br /> topography As such, the project was deemed to not result in any adverse impacts to the 100 year <br /> floodplain". <br /> The Board of Health comments were read into the record; "Private pool no comment", <br /> Mr. Furbush asked how the pool will be maintained and drained. <br /> Attorney Kirrane stated that there are drywells on the property. The plan does depict that the MDF <br /> which is the dry wells with a discharge access inlet which is next to the proposed pool. <br /> The subject property located at 1 Pontiac Road has a total lot area of 17,021 square feet located in <br /> R-3 Zoning District. <br /> A direct abutter asked the difference between a plunge pool and a regular pool. Mr. Morris said <br /> that the plunge pool is generally one piece. <br /> The abutter had no issues with the pool, but wanted to make sure there will be no issues with the <br /> drainage of the pool. <br /> Chairman Bonvie explained that there are drainage instructions depicted on the site plan noting <br /> the discharge pool water into a drywell. <br /> WRITTEN FINDING CRITERIA <br /> ARTICLE V -Nonconforming Buildings and Uses: <br /> §174-17. Continuance; Extensions; Alterations - Lawfully created structures or uses may be <br /> continued, although not conforming with the provisions of this chapter. Non-conforming single- <br /> or two-family dwelling structures may be changed, extended or altered if such change, extension <br /> or alteration complies with the dimensional requirements applicable to the lot under current <br /> provisions of§174-31 or, for lots which have been developed pursuant to §174-21, complies with <br /> 2 <br />
