Marsters, Trustee of the Greenwood <br /> Trust requests a Special Permit under §174-17.1, §174-33, and §174-17 of the Zoning Bylaws to <br /> raze and replace a pre-existing, non-conforming single-family dwelling with a new single-family <br /> structure on property located in an R-3 Zoning District, and the Popponesset Overlay District, at <br /> 48 Greenwood Road, Map 117, Parcel 323, Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. <br /> Notice was given by publication in The Mashpee Enterprise,a newspaper of general circulation in <br /> the Town of Mashpee, on May 10, 2024 and May 17, 2024 a copy of which is attached hereto and <br /> made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br /> Massachusetts General Laws Chapter 40A §9 and the Town of Mashpee Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on Wednesday,June 12,2024 <br /> at which time the following members of the Board of Appeals were present and acting throughout; <br /> Chairman, Ronald Bonvie, Board Members, Sharon Sangeleer, William A. Blaisdell, Jonathan <br /> Furbush, and Scott Goldstein. <br /> Attorney Christopher Kirrane represented the Owner, Joyce Marsters requesting a Special Permit <br /> under§174-17.1 to raze and replace a single family residence that is located within the Popponesset <br /> Overlay District. The Board is aware that the Popponesset Overlay requires 6,000 sq. of lot area, <br /> 60 ft. of frontage,a front setback of 25 ft., 15 ft. from the rear and side setbacks, 25%lot coverage, <br /> and 50 ft. from the wetland resource area. This lot is wholly within coastal storm flowage, and for <br /> lots that are 10,000 sq. ft. or over, there is 0 sq. ft. of total lot area. The lot coverage is 100%, and <br /> the setback to wetlands is zero. There is a non-conforming setback from Greenwood Road at 22.6 <br /> ft. The total lot area is currently 13.6%. <br /> 1 <br />
